Any person owning or controlling real estate or other\n\npremises who voluntarily and without compensation grants a license\n\nor privilege or otherwise permits the designation or use of the\n\nwhole or any part or parts of such real estate or premises for the\n\npurpose of sheltering persons, or providing a mass immunization and\n\nprophylaxis site or Strategic National Stockpile storage site during\n\nan actual or impending emergency or exercise shall, together with\n\nany successors in interest, if any, not be civilly liable for\n\nnegligently causing the death of, or injury to, any person on or\n\nabout such real estate or premises for loss of, or damage to, the\n\nproperty of such person; provided, that the injury or death was\n\ncaused by or incidental to the actual use of such premises for such\n\nreal, actual or impending emergency or exercise, and further\n\nprovided that nothing herein contained shall grant immunity from\n\ngross, willful or wanton acts of negligence.\n\nB. Neither the State of Oklahoma nor any political subdivision\n\nthereof nor any officer or employee of the State of Oklahoma or of\n\nany political subdivision thereof nor volunteer whose services have\n\nbeen accepted and utilized by an officer or employee of the State of\n\nOklahoma or of any political subdivision thereof for carrying out\n\nthe functions of this act shall be civilly liable for any loss or\n\ninjury resulting to any person's company, corporation or other legal\n\nentity as a result of any decision, determination, order or action\n\nof such employee in the performance of assigned duties and\n\nresponsibilities under this act during a stated emergency unless\n\nsuch loss or injury was caused by the gross negligence, or willfully\n\nand unnecessarily or by the wanton act of such state officer or\n\nemployee or volunteer.
