Stat. tit. 63, § 63-683.9","heading":"Natural or man-made emergency - Additional powers of","body":"Governor.\n\nThe provisions of this section shall be operative only during\n\nthe existence of a natural or man-made emergency. The existence of\n\nsuch emergency may be proclaimed by the Governor or by concurrent\n\nresolution of the Legislature if the Governor in such proclamation,\n\nor the Legislature in such resolution, finds that an emergency or\n\ndisaster has occurred or is anticipated in the immediate future.\n\nAny such emergency, whether proclaimed by the Governor or by the\n\nLegislature, shall terminate upon the proclamation of the\n\ntermination thereof by the Governor, or by passage by the\n\nLegislature of a concurrent resolution terminating such emergency.\n\nDuring such period as such state of emergency exists or continues,\n\nthe Governor shall have and may exercise the following additional\n\nemergency powers:\n\n1. To activate the Emergency Operations Plan, and to assume\n\nregulatory control over all essential resources of this state,\n\ndirectly or through the boards, agencies, offices and officers\n\nestablished by the Emergency Operations Plan, to determine\n\npriorities of such resources and allocate such resources as the\n\nGovernor may deem necessary in cooperation with the political\n\nsubdivisions of this state, the federal government or other states.\n\nFor purposes of this paragraph:\n\na. “resources” means all economic resources within this\n\nstate including, but not limited to, food, manpower,\n\nhealth, water, transportation, economic stabilization,\n\nelectric power, petroleum, gas, solid fuel, industrial\n\nproduction, construction and housing, and\n\nb. “economic stabilization” means the maintaining of the\n\nmonetary, taxation, and revenue policies of this state\n\nwithout a negative effect to the market economy and\n\nits operations and specifically excludes the\n\ndetermination of essential or nonessential private\n\nbusiness enterprises or the closing of private\n\nbusiness enterprises.\n\n2. To enforce all laws, rules and regulations relating to\n\nemergency management and to assume direct operational control of any\n\nor all emergency management forces and helpers in this state.\n\n3. To provide for the evacuation of all or part of the\n\npopulation from any stricken or threatened area or areas within this\n\nstate and to take such steps as are necessary for the receipt and\n\ncare of such evacuees.\n\n4. Subject to the provisions of the Oklahoma Constitution, to\n\nremove from office any public officer having administrative\n\nresponsibilities under this act for willful failure to obey any\n\norder, rule or regulation adopted pursuant to this act. Such\n\nremoval shall be upon charges after service upon such person of a\n\ncopy of such charges and after giving such person an opportunity to\n\nbe heard in the defense of such person. Pending the preparation and\n\ndisposition of charges, the Governor may suspend such person for a\n\nperiod not exceeding thirty (30) days. A vacancy resulting from\n\nremoval or suspension pursuant to this section shall be filled by\n\nthe Governor until it is filled as otherwise provided by law.\n\n5.
