Stat. tit. 63, § 63-685.3","heading":"Definitions","body":"As used in this act:\n\n1. \"Unavailable\" means either that a vacancy in office exists\n\nand there is no deputy authorized to exercise all of the powers and\n\ndischarge the duties of the office, or that the lawful incumbent of\n\nthe office, including any deputy exercising the powers and\n\ndischarging the duties of an office because of a vacancy, and the\n\nduly authorized deputy are absent or unable to exercise the powers\n\nand discharge the duties of the offices;\n\n2. \"Emergency interim successor\" means a person designated\n\npursuant to this act, in the event the officer is unavailable, to\n\nexercise the powers and discharge the duties of an office until a\n\nsuccessor is appointed or elected and qualified as may be provided\n\nby the Constitution, statutes, charters and ordinances or until the\n\nlawful incumbent is able to resume the exercise of the powers and\n\ndischarge the duties of the office;\n\n3. \"Office\" includes all state and local offices, the powers\n\nand duties of which are defined by the Constitution, statutes,\n\ncharters and ordinances, except the office of Governor, and except\n\nthose in the Legislature and the judiciary;\n\n4. “Emergency” means any occasion or instance for which, in the\n\ndetermination of the President of the United States or the Governor\n\nof the State of Oklahoma, federal or state assistance is needed to\n\nsupplement state and local efforts and capabilities to save lives\n\nand protect property and public health and safety, or to lessen or\n\navert threat or catastrophe in any part of the state;\n\n5. \"Political subdivision\" includes counties, cities, towns,\n\ndistricts, authorities and other public corporations and entities\n\nwhether organized and existing under charter or general law;\n\n6. \"Deputy\" means a person legally authorized by an officer to\n\nexercise the office or right which the official possesses, for and\n\nin place of the officer; and\n\n7. “Man-made disaster” means a disaster caused by acts of man\n\nincluding, but not limited to, an act of war, terrorism, chemical\n\nspill or release, and power shortage that require assistance in\n\naddition to the assistance of the local political subdivision.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"16890ff6ddbc1636398b10803b858fb355b0b2bf4589ba4cf2366d183bd271c1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-685.2","next":"us-ok/okla.-stat.-tit.-63-63-685.4"},"notice":"GroundRules: Original legal text.
