Stat. tit. 63, § 63-690.6","heading":"Funding of acquisition of real property by","body":"municipalities.\n\nA. The Legislature declares it to be necessary for the public\n\nhealth and welfare to provide a means for municipalities in this\n\nstate to implement measures to reduce losses from flood disasters.\n\nThe acquisition of real property for this objective shall constitute\n\na public purpose for which public funds may be expended.\n\nB. Municipalities are empowered and authorized to acquire fee\n\ntitle to real property and easements therein by purchase, gift,\n\ndevise, lease or otherwise for flood control.\n\nC. Title information, appraisal reports, offers, and\n\ncounteroffers are confidential until an option contract is executed\n\nor, if no option contract is executed, until thirty (30) days before\n\na contract or agreement for purchase is considered for approval by\n\nthe governing board of the municipality. However, each municipality\n\nmay, at its discretion, disclose appraisal reports to private\n\nlandowners during negotiations for acquisitions using alternatives\n\nto fee simple techniques, if the municipality determines that\n\ndisclosure of such reports will bring the proposed acquisition to\n\nclosure. In the event that negotiation is terminated by the\n\nmunicipality, the title information, appraisal report, offers, and\n\ncounteroffers shall become available to the public.\n\nD. Real property acquired for the purposes enumerated in this\n\nsection may also be used for recreational purposes, and whenever\n\npracticable such real property shall be open to the general public\n\nfor recreational uses. Except when prohibited by a covenant or\n\nother restriction, real property managed and controlled by the\n\nmunicipality may be used for multiple purposes, including, but not\n\nlimited to, agriculture and silviculture, as well as boating and\n\nother recreational uses.\n\nE.
