Stat. tit. 63, § 63-695.2","heading":"Purpose - Definitions - Statewide mutual aid system -","body":"Reimbursement.\n\nA. The purpose of the Oklahoma Intrastate Mutual Aid Compact is\n\nto create a system of intrastate mutual aid between participating\n\njurisdictions in the state.\n\nB. As used in the Oklahoma Intrastate Mutual Aid Compact:\n\n1. \"Jurisdiction\" means any county, city, town or municipal\n\ncorporation of the State of Oklahoma represented by an elected\n\ngoverning body and city-county health department created pursuant to\n\nthe Oklahoma Public Health Code.\n\nSovereign Tribal Nations in the State of Oklahoma shall also be\n\nconsidered jurisdictions under the Oklahoma Intrastate Mutual Aid\n\nCompact and participating unless electing not to participate or\n\nlater withdrawing from the system.\n\nPublic universities in this state which maintain CLEET-certified\n\nlaw enforcement agencies may elect to be considered jurisdictions\n\nunder the provisions of this act and shall retain the right to later\n\nwithdraw from the system;\n\n2. \"Emergency\" means any occasion or instance for which\n\nassistance is needed to supplement local efforts and capabilities to\n\nsave lives and to protect property and public health and safety, or\n\nto lessen or avert the threat of a catastrophe; and\n\n3. \"Emergency responder\" means anyone with special skills,\n\nqualifications, training, knowledge, and experience in the public or\n\nprivate sectors that would be beneficial to a participating\n\njurisdiction in response to a local emergency as defined in\n\napplicable law or ordinance or authorized drill or exercise.\n\nC. Each participant of the system shall recognize that\n\nemergencies transcend political jurisdictional boundaries and that\n\nintergovernmental coordination is essential for the protection of\n\nlives and property and for best use of available assets both public\n\nand private. The system shall provide for mutual assistance among\n\nthe participating jurisdictions in the prevention of, response to,\n\nand recovery from, any disaster or emergency, or any other activity,\n\nas determined by the participating jurisdictions. The system shall\n\nprovide for mutual cooperation among the participating jurisdictions\n\nin conducting disaster-related exercises, testing, or other training\n\nactivities outside actual declared emergency periods. This\n\nlegislation provides no immunity, rights, or privileges for any\n\nindividual responding to a state of emergency that is not requested\n\nand/or authorized to respond by a participating jurisdiction.\n\nParticipating jurisdictions will be ensured eligibility, to the\n\nfullest extent possible, for state and federal disaster funding.\n\nD. All jurisdictions within the state, upon enactment of this\n\nlegislation, are automatically a part of the statewide mutual aid\n\nsystem. A jurisdiction within the state may elect not to\n\nparticipate or to later withdraw from the system upon enacting an\n\nappropriate resolution by its governing body declaring that it\n\nelects not to participate in the statewide mutual aid system and\n\nproviding a copy of the resolution to the Oklahoma Department of\n\nEmergency Management. This legislation does not preclude\n\nparticipating jurisdictions from entering into supplementary\n\nagreements with another jurisdiction and does not affect any other\n\nagreement to which a jurisdiction may currently be a party or decide\n\nto be a party to.\n\nE. Many disasters begin as emergencies where local jurisdictions\n\nrequire fire service and/or law enforcement assistance. These\n\nservices would normally be requested and provided at the department\n\nlevel as normal day-to-day operations with no reimbursement. If an\n\nincident response expands beyond a normal day-to-day emergency into\n\na disaster situation, reimbursement for mutual aid services may be\n\nnecessary and will be in accordance with the Federal Emergency\n\nManagement Agency reimbursement policy.\n\nF. In support of the Emergency Management Compact, Section 684.1\n\net seq. of this title, the Governor or the representative of the\nth no reimbursement. If an\n\nincident response expands beyond a normal day-to-day emergency into\n\na disaster situation, reimbursement for mutual aid services may be\n\nnecessary and will be in accordance with the Federal Emergency\n\nManagement Agency reimbursement policy.\n\nF. In support of the Emergency Management Compact, Section 684.1\n\net seq. of this title, the Governor or the representative of the\n\nGovernor may request mutual aid assistance from local jurisdictions\n\nfor other states or their jurisdictions.
