Sleep diagnostic tests shall be ordered by a physician,\n\nphysician assistant or advance practice nurse.\n\nB. Sleep diagnostic tests shall be furnished:\n\n1. By a sleep diagnostic testing facility;\n\n2. By, or under arrangements made by, a hospital for its\n\npatients whereby the hospital exercises professional responsibility\n\nover the arranged services; or\n\n3. In the patient’s home.\n\nC. Sleep diagnostic testing facilities shall meet the following\n\nstandards:\n\n1. Sleep diagnostic testing facilities shall be supervised by a\n\nsupervising physician as defined by this act;\n\n2. On and after January 1, 2010, sleep diagnostic testing\n\nfacilities shall be fully or provisionally certified or accredited\n\nby the American Academy of Sleep Medicine (AASM), the Joint\n\nCommission or the Accreditation Commission for Healthcare (ACHC),\n\nexcept that the full or provisional certification or accreditation\n\nby AASM, the Joint Commission, or ACHC shall not be required until\n\nJune 30, 2010, for any sleep diagnostic testing facility that has\n\nsubmitted a complete application for certification or accreditation\n\nto AASM, the Joint Commission and/or ACHC on or before December 31,\n\n2009;\n\n3. An interpreting physician shall interpret the data generated\n\nby all sleep diagnostic tests conducted at a sleep diagnostic\n\ntesting facility; and\n\n4. Nonphysician personnel conducting sleep diagnostic tests\n\nshall perform their duties under the direction and supervision of\n\nthe supervising physician.\n\nD.
