Stat. tit. 63, § 63-7302","heading":"Tanning facilities - Age requirement - Posting","body":"requirement.\n\nA. As used in this act:\n\n1. \"Phototherapy device\" means equipment that emits ultraviolet\n\nradiation and is used in the diagnosis or treatment of disease or\n\ninjury;\n\n2. \"Tanning device\" means equipment that emits electromagnetic\n\nradiation having wavelengths in the air between two hundred (200)\n\nand four hundred (400) nanometers and that is used for tanning of\n\nhuman skin and any equipment used with that equipment including, but\n\nnot limited to, protective eyewear, timers and handrails. For the\n\npurposes of this paragraph, \"tanning device\" shall not include a\n\nphototherapy device used, or prescribed for use, by a physician;\n\n3. \"Tanning facility\" means any location, place, area,\n\nstructure or business that provides persons access to any tanning\n\ndevice, including tanning salons, health clubs, apartments and\n\ncondominiums, regardless of whether a fee is charged for access to\n\ntanning equipment; and\n\n4. \"Operator\" means a person designated by the owner of a\n\ntanning facility or tanning device lessee to operate or to assist\n\nand instruct in the operation and use of the tanning facility or\n\ntanning device.\n\nB. It shall be unlawful for any person under eighteen (18)\n\nyears of age to use any tanning device of any tanning facility in\n\nthis state.\n\nC. A person who is the owner, lessee or operator of a tanning\n\nfacility in this state shall post in a conspicuous place in each\n\ntanning facility owned, leased or operated by that person a notice\n\ndeveloped by the State Department of Health that states all of the\n\nfollowing:\n\n1. That it is unlawful for a tanning facility or operator to\n\nallow a person under eighteen (18) years of age to use any tanning\n\ndevice;\n\n2. That a tanning facility or operator that violates the\n\nprovisions of this act shall be subject to a civil penalty;\n\n3. That an individual may report a violation of one or more\n\nprovisions of this act to the local law enforcement agency; and\n\n4. The health risks associated with tanning including, but not\n\nlimited to, skin cancer, premature aging of skin, burns to the skin\n\nand adverse reactions to certain medications, foods and cosmetics.\n\nD.
