The Office of the Chief Medical Examiner (OCME) shall store\n\nbiological specimens in the control of the OCME for the potential\n\npurpose of independent analyses in matters of civil law, only upon\n\nreceipt of a written request for such storage and payment of a\n\nstorage fee. The fee shall be paid by the person requesting storage\n\nto the Office of the Chief Medical Examiner. The Board shall\n\npromulgate rules establishing a fee for storage of such biological\n\nspecimens which shall not exceed One Hundred Dollars ($100.00) per\n\nyear for a period of time not to exceed five (5) years. All fees\n\ncollected pursuant to the provisions of this subsection shall be\n\ndeposited to the credit of the Chief Medical Examiner Revolving\n\nFund.\n\nB. 1. The Office of the Chief Medical Examiner (OCME) is\n\nauthorized to perform drug screens on specimens in the custody of\n\nthe OCME, provided the request is made by an agency or party\n\nauthorized to receive such information. The OCME may limit drug\n\nscreens within the technical and physical capabilities of the OCME.\n\n2. The authorization for drug screens shall apply only to\n\nspecimens from cases already within the jurisdiction of the OCME and\n\nonly when the analyses are deemed by the Chief Medical Examiner or\n\nDeputy Chief Medical Examiner not to conflict with any investigation\n\nof the case by the state.\n\n3. The Board of Medicolegal Investigations shall establish a\n\nfee for drug screen services by rule.
