Stat. tit. 64, § 64-1085","heading":"State lands - Contracts for use - Damages","body":"When the United States of America, acting through the Secretary\n\nof the Interior or his duly authorized representative, or acting\n\nthrough the Secretary of War or his duly authorized representative,\n\nor when any irrigation district, conservancy district or water\n\nusers' association, organized under the laws of this state, acting\n\nby or through its board of directors, determines that the fee simple\n\ntitle or any lesser estate, interest, right or easement in and to\n\nany lands owned by the State of Oklahoma, including lands under the\n\ncontrol and management of the Commissioners of the Land Office,\n\nexcept land acquired by the state through and by reason of grants to\n\nthe state as made by the terms of the Enabling Act, is necessary or\n\nconvenient for the construction, development, operation or\n\nmaintenance of any irrigation, reclamation, water conservation and\n\nutilization, flood control, military or national defense project,\n\nneedful public buildings, or for any other public use or purpose, or\n\ndetermines that the construction, development, operation or\n\nmaintenance of any such project will result in the destruction,\n\nalteration, damaging or appropriation of any such lands, or any\n\nfacility, structure, easement or right of the State of Oklahoma, the\n\nUnited States of America, or the irrigation district, conservancy\n\ndistrict or water users' association, as the case may be, engaged in\n\nthe construction, operation, development or maintenance of any such\n\nproject, may file a certificate of such determination and a written\n\napplication for the acquisition of the title to any such land, or\n\nany lesser estate, right, interest or easement therein or thereto,\n\nor the right to destroy, alter, damage or appropriate any existing\n\nfacility, easement or right of the state, with the board,\n\ncommission, officer, or agency of the State of Oklahoma, having the\n\nmanagement or control of such state-owned lands, easements, rights\n\nor facilities. Upon the filing of such certificate and request the\n\nboard, officer, commission or agency having control or management of\n\nsuch land, easement, right or facility shall, with the consent and\n\napproval of the Governor, be authorized and empowered:\n\n1. To enter into contracts for sale and conveyance of, and to\n\nsell at private sale, the fee simple title or any lesser estate,\n\nright, interest or easement in and to or upon any such state-owned\n\nland to such applicant upon such terms and conditions and for such\n\nconsideration as such board, commission, officer or agency may deem\n\nproper.\n\n2. To enter into contracts and agreements to convey to such\n\napplicant the fee simple title or any lesser estate, right or\n\neasement in and to or upon any state-owned lands in exchange for\n\nother like lands or property.\n\n3. To enter into contracts and agreements granting to the\n\napplicant the right to destroy, alter, damage or appropriate any\n\nright, easement or facility owned by the State of Oklahoma, upon\n\nsuch terms and conditions and for such consideration as such board,\n\nofficer or agency may deem proper.\n\n4.
