Stat. tit. 64, § 64-1087","heading":"Negotiations and conveyances in lieu of condemnation","body":"proceedings.\n\nWhen the United States of America, acting through the Secretary\n\nof the Interior, or his duly authorized representative, or acting\n\nthrough the Secretary of War, or his duly authorized representative,\n\nshall determine that the construction, development, operation or\n\nmaintenance of any irrigation, reclamation, water conservation and\n\nutilization, flood control, military or national defense project, or\n\nany needful public building or other public project being\n\nconstructed, operated, developed or maintained under the laws of the\n\nUnited States, requires the appropriation of the fee simple title or\n\nany lesser estate, right or easement in and to or upon any tract of\n\nland owned by the State of Oklahoma and acquired by the state\n\nthrough and by reason of grants to the State of Oklahoma, made by\n\nthe terms of the Enabling Act, and files a certificate executed by\n\nthe Secretary of the Interior, or his duly authorized\n\nrepresentative, or by the Secretary of War, or his duly authorized\n\nrepresentative, certifying that the fee simple title or some lesser\n\nestate, right or easement in and to or upon such land will be\n\nappropriated and taken for such purposes under the power of eminent\n\ndomain, the Commissioners of the Land Office may enter into\n\nnegotiations with the United States of America, acting as aforesaid,\n\nfor the purpose of determining by agreement the amount which the\n\nState of Oklahoma will be entitled to receive by reason of such\n\nappropriation for said purposes. If the Commissioners of the Land\n\nOffice are able to agree with the United States of America, acting\n\nas aforesaid, on the amount to which the State of Oklahoma will be\n\nentitled by reason of such appropriation, the Commissioners of the\n\nLand Office, by and with the consent of the Governor of the State of\n\nOklahoma, may upon payment of the amount of compensation agreed upon\n\nand in recognition of the taking and appropriation of such land and\n\nin lieu of condemnation proceedings for the determination of the\n\namount of such damages, execute a deed of conveyance evidencing the\n\ntitle or right acquired by the United States of America in the\n\nexercise of its sovereign powers and further evidencing the payment\n\nand receipt of full compensation for the land, right, easement or\n\nestate so appropriated. The execution and delivery of said deed\n\nshall operate as conclusive evidence of such appropriation and\n\ntaking and the United States of America shall thereupon be\n\nauthorized to enter upon and take possession of the land to the\n\nextent of such appropriation as evidenced by said deed. Said deed\n\nof conveyance shall not be effective unless the approval of the\n\nGovernor is endorsed thereon in writing. The Commissioners of the\n\nLand Office shall have like power to execute deeds of conveyance in\n\nlieu of condemnation proceedings when any irrigation district,\n\nconservancy district or water users' association, organized under\n\nthe laws of the State of Oklahoma, certifies by and through its\n\nboard of directors the necessity of taking of any such lands, and\n\nupon such certification by such irrigation district, conservancy\n\ndistrict or water users' association, the provisions of this section\n\nshall apply with like force and effect to all such state-owned\n\nlands, or any lesser estate, right or easement therein or thereon,\n\nso appropriated by any such district or association.\n\nDeeds in lieu of condemnation proceedings shall be executed by\n\nthe presiding officer of the Commissioners of the Land Office and\n\nattested by the Secretary but no such deed shall be effective unless\n\nand until the approval of the Governor is endorsed thereon in\n\nwriting.","path":["OK Code","Title 64"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os64.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"63896bb49aa24ad71a299a3221a72ebd275ec97288f58a769b4c27129839029c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-64-64-1086","next":"us-ok/okla.-stat.-tit.-64-64-1088"},"notice":"GroundRules: Original legal text.
