Stat. tit. 65, § 65-4-102","heading":"Procedure for establishment and termination","body":"A library system may be created by resolution or ordinance\n\napproved by the boards of county commissioners or by the governing\n\nbodies of all cities or towns of two thousand (2,000) or more\n\naccording to the latest U.S. Census within the proposed district, or\n\nby the county seat town if no city or town within a county has a\n\npopulation of at least two thousand (2,000), subject to approval by\n\nthe Oklahoma Department of Libraries Board. Such resolution and\n\nordinances shall specify the type of system to be created, the\n\ndistrict to be served, organization of the governing board of the\n\nsystem, proposed financing including agreement to call for a vote of\n\nthe people as necessary for special tax levies, and shall constitute\n\napplication for approval by the Oklahoma Department of Libraries\n\nBoard when submitted to the Board.\n\nA library system may be created upon initiative of the county,\n\ncity and town governing bodies concerned, or upon presentation of\n\npetitions to the board of county commissioners of each county signed\n\nby not less than ten (10%) percent of of the qualified electors of\n\neach county voting in the latest preceding general election. Upon\n\nreceipt of such petitions, the board of county commissioners of each\n\ncounty shall forthwith call for a countywide vote on the proposed\n\nlibrary system.\n\nWhen approval of the proposed system is granted by the Oklahoma\n\nDepartment of Libraries Board, the county, city and town governing\n\nbodies shall proceed with appointment of the system board and\n\nfinancing.\n\nAfter appointment of the governing board of the library system,\n\nit may request demonstration library services by the Oklahoma\n\nDepartment of Libraries before approval of special tax levies and/or\n\nmay request a grant of funds for interim services before collection\n\nof special tax levies by the people of the district.\n\nThe boards of county commissioners and the governing bodies of\n\ncities and towns involved in creation of a library system, and the\n\ngoverning board of the library system, are authorized to enter into\n\ncontracts and agreements by and between such governing bodies and\n\nwith other such library systems, special and school and college\n\nlibraries, and the Oklahoma Department of Libraries in affecting the\n\npurposes of this article and other articles of this Code.\n\nAfter a system has been created, another county or counties may\n\nbe added to the system by action of the governing bodies of the\n\napplicant counties and cities as provided in the procedure for\n\nestablishment.\n\nAny library system created under the provisions of this Code may\n\nbe terminated, or a part thereof may withdraw and resulting special\n\ntax levies shall be discontinued only by majority vote of qualified\n\nelectors voting in an election called by petitions signed by not\n\nless than twenty (20%) percent of the qualified electors voting in\n\nthe latest preceding general election of the county or counties\n\nwishing to terminate or withdraw.\n\nThis provision for termination of all or a part of a library\n\nsystem shall not prohibit the reorganization of any system, or the\n\ntransfer of part of a system to another system or the merging of\n\nsystems, by act of the county, city and town governing bodies with\n\napproval of the Oklahoma Department of Libraries Board, provided\n\nthat such changes do not result in termination of library service in\n\nany other area for which such service has been approved.","path":["OK Code","Title 65"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os65.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bb93836bb5632b2465d05256ba61113b767869f2c69f4dffe1ea02d2e2ac7f41","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-65-65-4-101","next":"us-ok/okla.-stat.-tit.-65-65-4-103"},"notice":"GroundRules: Original legal text.
