The metropolitan library commission for any county with a\n\npopulation of less than six hundred thousand (600,000) as determined\n\nby the latest Federal Decennial Census shall consist of eleven (11)\n\nmembers. Six of the members shall be appointed by the mayor of the\n\ncounty seat city, subject to approval of the governing body of that\n\ncity. Three of the members shall be appointed by the board of\n\ncounty commissioners. The mayor of the county seat city and the\n\nchairman of the board of county commissioners shall be ex officio\n\nmembers of the commission and shall be entitled to vote on all\n\nmatters. The initial appointments by the city shall designate two\n\nmembers to serve a term of three (3) years, two members to serve a\n\nterm of two (2) years, and two members to serve a term of one (1)\n\nyear. The initial appointments by the county shall designate one\n\nmember to serve a term of three (3) years, one member to serve a\n\nterm of two (2) years, and one member to serve a term of one (1)\n\nyear. The terms of such initial appointees and the terms of all\n\nfuture appointees of both the city and county shall expire July 31\n\nof the year the term expires, regardless of the calendar date when\n\nthe appointments are made. Subsequent appointments of either the\n\ncity or the county shall be for three-year terms, except in the case\n\nof an appointment to fill a vacancy in the membership of the\n\ncommission, which latter appointment shall be for the balance of the\n\nunexpired term of the member whose death, resignation, or removal\n\nhas created the vacancy. A member of this commission, once\n\nqualified, can be removed during the term of office only for\n\nmisconduct or neglect of duty and, if the member requests a hearing\n\nbefore the governing body which appointed the member, after a\n\nhearing has been held. All members of the commission shall serve\n\nwithout compensation and shall serve until their successors are\n\nappointed and confirmed. The librarian provided for in Section 556\n\nof this title shall be the secretary of the metropolitan library\n\ncommission and shall be a nonvoting member of the commission.\n\nB. 1. Beginning July 31, 2007, the metropolitan library\n\ncommission for any county with a population of six hundred thousand\n\n(600,000) or more as determined by the latest Federal Decennial\n\nCensus shall consist of the following members:\n\na. thirteen members who shall be appointed by the mayor\n\nof the county seat city, subject to the approval of\n\nthe governing body of that city,\n\nb. one member who shall be appointed by the board of\n\ncounty commissioners to serve as an at-large member of\n\nthe commission representing citizens living in areas\n\nof the county not otherwise represented by an\n\nappointee,\n\nc. one member from each municipality in the county which\n\nhas a library or library extension located within the\n\nboundaries of the municipality and which is a part of\n\nthe metropolitan library system, who shall be\n\nappointed by the mayor of each municipality\n\nrespectively, subject to the approval of the governing\n\nbody of each municipality,\n\nd. the mayor of the county seat city, who shall be an ex\n\nofficio member, and\n\ne. the chair of the board of county commissioners, who\n\nshall be an ex officio member.\n\n2. Any member serving on a commission subject to the provisions\n\nof this subsection on the effective date of this act may at the\n\ndiscretion of the appointing authority continue to serve until\n\nexpiration of the term.\n\n3. For any commission created pursuant to this subsection, the\n\nmayor of the county seat city and the chairman of the board of\n\ncounty commissioners shall be ex officio members of the commission\n\nand shall be entitled to vote on all matters.\n\n4. For any commission created pursuant to this subsection, the\n\nterms of the initial appointees of the county seat city shall be\n\nstaggered so that the terms of all the members do not expire in the\no this subsection, the\n\nmayor of the county seat city and the chairman of the board of\n\ncounty commissioners shall be ex officio members of the commission\n\nand shall be entitled to vote on all matters.\n\n4. For any commission created pursuant to this subsection, the\n\nterms of the initial appointees of the county seat city shall be\n\nstaggered so that the terms of all the members do not expire in the\n\nsame year. The terms of all appointees to the commission shall\n\nexpire July 31 of the year the term expires, regardless of the\n\ncalendar date the appointments are made. All appointments to the\n\ncommission shall be for three-year terms, except in the case of an\n\nappointment to fill a vacancy in the membership of the commission,\n\nwhich shall be for the balance of the unexpired term. Once\n\nqualified, a member of the commission may be removed from office\n\nonly for misconduct or neglect of duty. If the member requests a\n\nhearing before the governing body which appointed the member,\n\nremoval shall be effective only after a hearing has been held. All\n\nmembers of the commission shall serve without compensation and shall\n\nserve until a successor is appointed and confirmed.
