Stat. tit. 66, § 66-190","heading":"Blocking vehicular traffic at railroad intersections –","body":"Limits – Exceptions - Penalties.\n\nA. As it is immediately necessary for the safety and welfare of\n\nthe people, no railcar shall be brought to rest in a position which\n\nblocks vehicular traffic at a railroad intersection with a public\n\nhighway or street for longer than ten (10) minutes.\n\nB. Municipalities, county sheriffs and the Oklahoma Highway\n\nPatrol shall have the authority to issue a citation to any person or\n\ncorporation that violates a provision of this section. Such person\n\nor corporation shall be subject to a fine of up to One Thousand\n\nDollars ($1,000.00) for each violation. Seventy-five percent (75%)\n\nof the collected fine shall be deposited to the credit of the\n\ngeneral fund of the entity that issued the citation and the\n\nremaining twenty-five percent (25%) shall be credited to the\n\nCorporation Commission Revolving Fund established in Section 180.7\n\nof Title 17 of the Oklahoma Statutes. A copy of the citation, along\n\nwith any information regarding train identification, shall be sent\n\nto the Corporation Commission for enforcement of the penalty at a\n\nhearing before an administrative law judge of the Commission. The\n\nviolating entity or individual may appeal the administrative law\n\njudge's decision to the Commission en banc. The Commission shall\n\nannually deliver an electronic report detailing the number of\n\nviolations, number of rulings, number of appeals and amount of fines\n\nassessed under this section. Commission reports shall be delivered\n\nto the Speaker of the Oklahoma House of Representatives, the\n\nPresident Pro Tempore of the Oklahoma State Senate and the Governor.\n\nThe Commission shall promulgate rules and procedures to effectuate\n\nthe provisions of this section.\n\nC. 1. Railroads or other persons, firms or corporations\n\noperating over tracks within the State of Oklahoma shall not block\n\nvehicle traffic at any railroad grade crossing for a period of time\n\nin excess of ten (10) minutes except if the train is moving in a\n\ncontinuous forward or backward direction, or if the train is stopped\n\nfor an emergency condition, including an accident, derailment,\n\ncritical mechanical failure, track or bridge washout, storm, flood\n\nor other emergency situation.\n\n2. A one-time exception of up to, but not exceeding, ten (10)\n\nadditional minutes shall be authorized under the following\n\nconditions:\n\na. when a train and its crew, operating under the rules\n\nof the Federal Railroad Administration (FRA), are\n\nunable to complete a switching maneuver while setting\n\nout or picking up railcars within the ten (10) minutes\n\nas set forth in paragraph 1 of this subsection,\n\nb. when a train is stopped to allow the passage of a\n\nsecond train and the stopped train has exhausted the\n\nten (10) minutes as set forth in paragraph 1 of this\n\nsubsection, or if the arrival of the second train is\n\nimminent and separation and coupling of the stopped\n\ntrain would result in further unnecessary blocking of\n\nmotor vehicle or pedestrian traffic, and\n\nc. when a train is stopped for a red train signal.\n\n3. When a train is cut or separated to prevent blocking of\n\nmotor vehicle traffic at a public crossing, and a working charging\n\nstation exists, the time required for recoupling a train and\n\nperforming air tests as required by the FRA shall not be considered\n\na violation of this section.\n\n4.
