Stat. tit. 66, § 66-58","heading":"Commissioners to act in all cases","body":"Freeholders so appointed shall be the commissioners to assess\n\nall the damages to the owners of real property in said county or\n\nsubdivision; and said corporation may, at any time after their\n\nappointment, upon the refusal of any owner or guardian of any owner\n\nof lands in said county or subdivision to grant the right-of-way as\n\naforesaid, by giving said owner or guardian ten (10) days' notice\n\nthereof in the manner required on the original appointment of\n\ncommissioners, have the damages assessed in the manner hereinbefore\n\nprescribed.
