Stat. tit. 66, § 66-63","heading":"Municipal authorities may convey - Improvement districts -","body":"How highways occupied.\n\nIf it shall be necessary, in the location of any part of any\n\nrailroad, to occupy any road, street, alley or public way or ground\n\nof any kind, or any part thereof, it shall be competent for the\n\nmunicipal, or other corporation, or public officer, or public\n\nauthorities owning or having charge thereof, and the railroad\n\ncorporation, to agree upon the manner, and upon the terms and\n\nconditions upon which the same may be used or occupied; and if said\n\nparties shall be unable to agree thereon, and it shall be necessary,\n\nin the judgment of the directors of such railroad corporation, to\n\nuse or occupy such road, street, alley, or other public way or\n\nground, such corporation may appropriate so much of the same as may\n\nbe necessary for the purpose of such road, in the same manner and\n\nupon the same terms as are provided in this chapter for the\n\nappropriation of the property of individuals. Provided, however,\n\nthat if any railroad shall be so located as to occupy any road or\n\npublic way, constructed by any road improvement district organized\n\nunder the laws of this state, for a greater distance than one-fourth\n\n(1/4) of one (1) mile, before any such railroad shall acquire the\n\nright to enter upon, use, occupy and maintain its railroad along\n\nsuch, and upon such public highway, it shall file in the office of\n\nthe county clerk, in the county wherein such road improvement\n\ndistrict is located, a statement showing the total length of the\n\nline proposed to be located along, and upon, such public highway,\n\nthe amount of compensation they propose to pay to such road\n\nimprovement district for the use of such public highway, and the\n\ntime and manner in which such payment is to be made. Immediately\n\nupon the filing of such proposal, the county clerk shall notify the\n\ncounty commissioners and shall cause same to be published in one\n\nissue, at the expense of the railroad company, of some newspaper of\n\ngeneral circulation within said road improvement district. The\n\ncounty commissioners shall meet within ten (10) days and shall\n\nimmediately order an election to be held, within such road\n\nimprovement district, for the purpose of submitting, to the\n\nqualified electors within such road improvement district, the\n\nquestion of accepting or rejecting the proposal of such railroad\n\ncompany. They shall pass all orders and resolutions necessary for\n\nthe holding of such elections and shall canvass the returns thereof,\n\nand declare the result, and if three-fifths (3/5) of all the votes\n\ncast on such question shall be in favor of the acceptance of the\n\nproposal of said railroad company, the same shall be accepted and\n\nthe board of county commissioners shall have power to execute all\n\ncontracts and do all things necessary to secure to said road\n\nimprovement district the performance of the conditions of such\n\nproposal of said railroad company.\n\nR.L. 1910, § 1410; Laws 1910-11, c. 71, p. 167, § 1, emerg. eff.\n\nMarch 11, 1911.","path":["OK Code","Title 66"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os66.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"05f2b111e441c91a0d5ac5bdf0a89d1357086798231ac57383b92f8ccfc2d990","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-66-66-62","next":"us-ok/okla.-stat.-tit.-66-66-64"},"notice":"GroundRules: Original legal text.
