Stat. tit. 67, § 67-2","heading":"What necessary when certified copies cannot be had","body":"Whenever the loss or destruction of any such record or part\n\nthereof shall have happened, and such defect cannot be supplied, as\n\nprovided in the next preceding section, any person interested\n\ntherein may make a written application to the proper court of the\n\ncounty wherein the records were kept, verified by affidavit, showing\n\nthe loss or destruction thereof; that certified copies thereof\n\ncannot be obtained by the person making such application; the\n\nsubstance of the record so lost or destroyed; that such loss or\n\ndestruction occurred without the fault or neglect of the person\n\nmaking such application, and that the loss or destruction of such\n\nrecord, unless supplied, will or may result in damage to the person\n\nmaking such application; and thereupon said court shall cause said\n\napplication to be entered of record in said court, and due notice of\n\nsaid application shall be given that said application will be heard\n\nby said court. And if, upon such hearing, said court shall be\n\nsatisfied that the statements contained in said written application\n\nare true, said court shall make an order, reciting the substance and\n\neffect of said lost or destroyed record; which order shall be\n\nentered of record in said court, and have the same effect which said\n\noriginal record would have had if the same had not been lost or\n\ndestroyed, so far as concerns the person making such application,\n\nand the persons who shall have been notified, as provided in this\n\nsection. The record, in all cases where the proceeding was in rem,\n\nand no personal service was had, may be supplied upon like notice,\n\nas nearly as may be, as in the original proceeding.
