Stat. tit. 67, § 67-22","heading":"Abstractor may petition","body":"\n\nAny owner of said abstracts, copies or minutes shall have the\n\nright to file a petition at any regular term of the county or\n\ndistrict court of the county, in which petition he shall set forth\n\nthe manner in which such abstracts, copies or minutes were made or\n\nprocured, and if the court shall find from the evidence produced\n\n(which evidence shall be preserved as hereinbefore provided) that\n\nsaid abstracts, copies, or minutes were fairly made in the regular\n\ncourse of business before such destruction of the records, the court\n\nshall enter his decree to that effect, and the evidence produced on\n\nthe trial of said cause shall be entered of record at large as a\n\npart of the decree of the court. And thereupon said abstracts,\n\ncopies or minutes of said burnt records shall be taken as prima\n\nfacie evidence of all such matters as they contain (but no such\n\nabstract, copies, minutes or extracts shall be taken or held to be\n\nprima facie evidence of what they contain that does not purport to\n\nrecite all deeds and mortgages previously executed and recorded, and\n\ndescribing the several tracts of land and town lots to which said\n\nabstracts, copies, minutes or extracts refer from the date of\n\nentry): Provided, that all abstracts to separate tracts of lands\n\nmade by the owner of said abstracts shall also be taken as prima\n\nfacie evidence of what they contain when they shall be accompanied\n\nwith an affidavit signed and sworn to by the owner of said\n\nabstracts, copies, minutes or extracts, showing that said separate\n\nabstracts contain a full, true and perfect copy of all transfers on\n\nthe tracts set forth in said separate abstracts as appears upon said\n\nabstracts, copies, minutes or extracts, as established by the county\n\nor district court of the county, and that said separate abstracts\n\ncontain all deeds, mortgages and other liens on said separate\n\ntracts, as shown by said abstracts, copies, minutes or extracts\n\nestablished as aforesaid.","path":["OK Code","Title 67"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os67.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5feaa2d8afc42e3aaf51fbe761d392494382b1420b605c140b09fac983982a1c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-67-67-217","next":"us-ok/okla.-stat.-tit.-67-67-23"},"notice":"GroundRules: Original legal text.
