Stat. tit. 67, § 67-46","heading":"Proceedings on hearing","body":"If no demurrer or other pleading or answer shall, be filed by\n\nthe third day of said term, or by the day allowed by the order of\n\nsaid court, as above provided, the petition may be taken as\n\nconfessed, and a decree entered according to the prayer of said\n\npetition, upon proof of the facts stated in said petition, but if\n\nany person shall file an answer, as aforesaid, to such petition, the\n\ncourt may hear evidence, or order a reference to a referee or\n\nspecial commissioner to take evidence and report, when the same\n\nproceedings shall be had as on a reference to a referee or special\n\ncommissioner under and according to the practice in the courts of\n\nthis state.
