The purpose of this act is to enact a licensing program for\n\noutdoor display fireworks for Oklahoma entities and a licensing\n\nprogram for individuals conducting outdoor fireworks displays in\n\nthis state. The purpose of these programs is to ensure a level of\n\ncompetence that promotes safety for the public, fire service\n\npersonnel, and fireworks display operators and their employees and\n\nservice personnel. It is not the purpose of this act to regulate\n\nUnited States Department of Transportation Division 1.4G consumer\n\nfireworks as defined by NFPA standards or paragraph 2 of Section\n\n1622 of Title 68 of the Oklahoma Statutes.\n\nB. As used in this act:\n\n1. “Licensed outdoor display operator” means an individual who\n\nby experience, training, and examination recognized and approved by\n\nthe State Fire Marshal has demonstrated the necessary knowledge and\n\nability to safely assemble, discharge and supervise outdoor display\n\nfireworks in accordance with NFPA 1123;\n\n2. \"Operator\" shall have the same meaning as \"licensed outdoor\n\ndisplay operator\", as defined in paragraph 1 of this subsection;\n\n3. “Display fireworks” means fireworks devices that are\n\nprimarily intended for commercial displays which are designed to\n\nproduce visible and/or audible effects by combustion, deflagration\n\nor detonation. Display fireworks include, but are not limited to,\n\nsalutes containing more than two grains (130mg) of explosive\n\ncomposition, aerial shells containing more than forty (40) grams of\n\npyrotechnic compositions and other exhibition display items that\n\nexceed the limits for consumer fireworks according to the United\n\nStates Department of Transportation (DOT);\n\n4. “Event” means any function or gathering at which there will\n\nbe a fireworks display. If a function or gathering lasts more than\n\none (1) day, each day is a separate event. Event does not include\n\nany function or gathering at which only consumer fireworks, as\n\ndefined in paragraph 2 of Section 1622 of Title 68 of the Oklahoma\n\nStatutes, will be used exclusively;\n\n5. \"Distributor\" means any person engaged in the business of\n\nmaking sales of display fireworks as defined in paragraph 3 of\n\nSection 1622 of Title 68 of the Oklahoma Statutes or materials to\n\nOklahoma-licensed or -permitted entities for the purpose of\n\nproviding fireworks or pyrotechnic display services in this state.\n\nA distributor may sell display fireworks only to Oklahoma-licensed\n\nor -permitted entities. An out-of-state distributor shall not be\n\nrequired to obtain an Oklahoma license when selling exclusively to a\n\nholder of an Oklahoma manufacturer, distributor, or wholesaler\n\nlicense;\n\n6. “NFPA” means the National Fire Protection Association;\n\n7. “NFPA 1123” means the NFPA publication entitled “NFPA 1123:\n\nCode for Fireworks Display”, 2010 Edition or any subsequent edition\n\nthat has been adopted by the State Fire Marshal by rule;\n\n8. “NFPA 1124” means the NFPA publication entitled “NFPA 1124:\n\nCode for Manufacture, Transportation, Storage, and Retail Sale of\n\nFireworks and Pyrotechnic Articles”, 2006 Edition or any subsequent\n\nedition that has been adopted by the State Fire Marshal by rule;\n\n9. “NFPA 1126” means the NFPA publication entitled “NFPA 1126:\n\nStandards for the Use of Pyrotechnics Before a Proximate Audience”,\n\n2011 Edition or any subsequent edition that has been adopted by the\n\nState Fire Marshal by rule;\n\n10. “Outdoor fireworks display” means a presentation of display\n\nfireworks for a public or private gathering as defined by NFPA 1123;\n\n11. “Proximate pyrotechnics” means pyrotechnic devices for\n\nprofessional use only, used outdoors or indoors, that are similar to\n\nconsumer fireworks in chemical composition but that are not intended\n\nfor consumer use, and that are defined by NFPA 1126 as 1.4G or 1.4S\n\nfireworks or pyrotechnics;\n\n12. “Proximate pyrotechnic display” means the use of\n\npyrotechnic devices and materials, 1.4G or 1.4S fireworks or\nate pyrotechnics” means pyrotechnic devices for\n\nprofessional use only, used outdoors or indoors, that are similar to\n\nconsumer fireworks in chemical composition but that are not intended\n\nfor consumer use, and that are defined by NFPA 1126 as 1.4G or 1.4S\n\nfireworks or pyrotechnics;\n\n12. “Proximate pyrotechnic display” means the use of\n\npyrotechnic devices and materials, 1.4G or 1.4S fireworks or\n\npyrotechnics when any portion of the audience is closer than\n\npermitted by NFPA 1123, and subject to NFPA 1126 requirements; and\n\n13. “Sponsor” means any person or organization which contracts\n\nwith a licensed entity, licensed distributor or licensed outdoor\n\ndisplay operator to conduct a fireworks display.","path":["OK Code","Title 68"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d1b5a302f8473847bde926c54a92106850a4e14fb87bf42650ebe8e532383ca7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-68-68-1634","next":"us-ok/okla.-stat.-tit.-68-68-1636"},"notice":"GroundRules: Original legal text.
