Stat. tit. 68, § 68-202","heading":"Definitions","body":"The terms defined in this section shall, in this article, be\n\nconstrued as follows:\n\n(a) The term \"Tax Commission\" shall mean the Oklahoma Tax\n\nCommission;\n\n(b) The term \"state tax\" shall mean any tax which is payable to,\n\ncollectible by or administered by the Oklahoma Tax Commission;\n\n(c) The term \"state tax law\" shall mean any law of the State of\n\nOklahoma which levies, imposes, or relates to a state tax as herein\n\ndefined;\n\n(d) The term \"taxpayer\" shall mean:\n\n(1) Any person owing or liable to pay any state tax;\n\n(2) Any person required to file a report, a return, or remit any\n\ntax required by the provisions of any state tax law;\n\n(3) Any person required to obtain a license or a permit or to\n\nkeep any records under the provisions of any state tax law;\n\n(e) The term \"person\" means an individual, trust, estate,\n\nfiduciary, partnership, limited liability company, or a corporation,\n\nand shall include any municipal subdivision of the state;\n\n(f) The term \"individual\" means a natural person;\n\n(g) The term \"corporation\" means an organization, other than a\n\npartnership, as hereinafter defined:\n\n(1) Created or organized under the laws of Oklahoma;\n\n(2) Qualified to do or doing business in Oklahoma, in a\n\ncorporate or organized capacity, by virtue of creation or\n\norganization under the laws of the United States or of some state,\n\nterritory or district, or of a foreign country;\n\n(3) Associations, joint-stock companies, insurance companies,\n\nincluding surety and bond companies;\n\n(4) Business trusts, which shall mean and include common law\n\ntrusts, such as Massachusetts trusts and every other business\n\norganization consisting essentially of an arrangement whereby\n\nproperty is conveyed to one or more trustees for purposes other than\n\nthe protection and conservation of assets or the protection of\n\ndebtholders; and\n\n(5) National banking associations, state banks, and trust\n\ncompanies;\n\n(h) The term \"fiduciary\" means a guardian, trustee, executor,\n\nadministrator, receiver, conservator or any person, whether\n\nindividual or corporate, acting in any fiduciary capacity for any\n\nperson, trust or estate;\n\n(i) The term \"partnership\" includes a syndicate, group, pool,\n\njoint venture or other unincorporated organization, through or by\n\nmeans of which any business, financial operation or venture is\n\ncarried on, and which is not a trust or estate or classed as a\n\ncorporation within the provisions of this article; and the term\n\n\"partner\" includes a member of such syndicate, group, pool, joint\n\nventure or organization;\n\n(j) The term \"limited liability company\" means an organization\n\nother than a corporation or partnership which is organized pursuant\n\nto Section 2000 et seq. of Title 18 of the Oklahoma Statutes.\n\nExcept as otherwise specifically provided, for all purposes under\n\nTitle 68 of the Oklahoma Statutes, a domestic limited liability\n\ncompany shall be treated the same and taxed as a domestic\n\npartnership and a foreign limited liability company shall be treated\n\nthe same and taxed as a foreign partnership, provided that such\n\ndomestic or foreign limited liability companies are classified as\n\npartnerships for federal income tax purposes.","path":["OK Code","Title 68"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"422f771ed903cd6efb00157d489424b8cdc94e1f91437502a2d248310e8d97e8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-68-68-201","next":"us-ok/okla.-stat.-tit.-68-68-203"},"notice":"GroundRules: Original legal text.
