Stat. tit. 68, § 68-2355.1P-2","heading":"Definitions","body":"As used in this act:\n\n1. \"Distributive share\" means a member's percentage share of\n\nOklahoma net entity income or net entity loss;\n\n2. \"Electing pass-through entity\" means any pass-through entity\n\nas defined in paragraph 6 of this section that has made an election\n\npursuant to subsection F of Section 4 of this act to pay income tax\n\nas computed pursuant to Section 2358 of Title 68 of the Oklahoma\n\nStatutes;\n\n3. \"Indirect member\" means, with respect to any particular\n\nelecting pass-through entity, an individual, fiduciary, or entity\n\nthat (i) owns an interest in a pass-through entity other than the\n\nelecting pass-through entity and (ii) has been allocated items of\n\nOklahoma income, gain, loss or deduction that the electing pass-\n\nthrough entity included in computing its tax pursuant to the\n\nprovisions of the Pass-Through Entity Tax Equity Act of 2019;\n\n4. \"Member\" means any individual, fiduciary, or entity holding\n\nan ownership interest in an electing pass-through entity;\n\n5. \"Oklahoma net entity income\" or \"Oklahoma net entity loss\"\n\nmeans the positive or negative sum of an electing pass-through\n\nentity's items of Oklahoma income, gain, loss, and deduction\n\ndetermined under Section 2351 et seq. of Title 68 of the Oklahoma\n\nStatutes, regardless of whether any such items are required for\n\nfederal income tax purposes to be separately stated; and\n\n6. \"Pass-through entity\" means a general partnership, a limited\n\npartnership, a limited liability partnership, a limited liability\n\nlimited partnership, a limited liability company, or a corporation,\n\nif any of the enumerated entity's items of income, gain, loss, and\n\ndeduction, as applicable, are subject to being included on another\n\nperson's return for federal income tax purposes under Subchapter K\n\nor Subchapter S of the Internal Revenue Code.","path":["OK Code","Title 68"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d9f589fde77bddcc3f921b605a3879704fbafa3538f2e46d20bc08f02c4c5739","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-68-68-2355.1p-1","next":"us-ok/okla.-stat.-tit.-68-68-2355.1p-3"},"notice":"GroundRules: Original legal text.
