Stat. tit. 68, § 68-2357.409","heading":"Tax credit for faculty preceptors who conduct a","body":"preceptorship rotation.\n\nA. As used in this section:\n\n1. “Advanced practice registered nursing student” means an\n\nindividual participating in a state-supported training program in\n\nthis state that is approved by the Oklahoma Board of Nursing for the\n\ntraining of individuals to become Advanced Practice Registered\n\nNurses as defined in Section 567.3a of Title 59 of the Oklahoma\n\nStatutes;\n\n2. “Faculty preceptor” means an allopathic physician,\n\nosteopathic physician, physician assistant, or Advanced Practice\n\nRegistered Nurse licensed in this state and who provides primary\n\ncare services;\n\n3. “Medical school” means a legally chartered medical school\n\nrecognized by the Oklahoma State Regents for Higher Education;\n\n4. “Medical student” means a student currently enrolled in a\n\nmedical school in this state or a school or college of osteopathic\n\nmedicine in this state;\n\n5. “Physician assistant student” means an individual\n\nparticipating in a state-supported training program in this state\n\nthat is approved by the State Board of Medical Licensure and\n\nSupervision for the training of individuals to become physician\n\nassistants as defined in Section 519.2 of Title 59 of the Oklahoma\n\nStatutes;\n\n6. “Preceptorship rotation” means a period of preceptorship\n\ntraining of one or more medical students, residents, physician\n\nassistant students, or advanced practice registered nursing students\n\nthat in aggregate totals one hundred sixty (160) hours;\n\n7. “Preceptorship training” means uncompensated training in\n\nprimary care services of a medical student, resident, physician\n\nassistant student, or advanced practice registered nursing student\n\nenrolled in a training program in this state;\n\n8. “Primary care services” means family medicine, geriatrics,\n\ngeneral internal medicine, general pediatrics, or the substantial\n\nequivalent of such services when performed by a physician assistant\n\nor Advanced Practice Registered Nurse;\n\n9. “Resident” means an allopathic physician or osteopathic\n\nphysician pursuing postgraduate medical education at a program\n\nsupported by a medical school or a school or college of osteopathic\n\nmedicine in this state; and\n\n10. “School or college of osteopathic medicine” shall have the\n\nsame meaning as provided by Section 631 of Title 59 of the Oklahoma\n\nStatutes.\n\nB. 1. For tax years 2026 through 2035, there shall be allowed\n\na credit against the tax imposed pursuant to Section 2355 of Title\n\n68 of the Oklahoma Statutes for a faculty preceptor who conducts a\n\npreceptorship rotation.\n\n2. Except as provided for by subsection F of this section,\n\ncredit shall be allowed for no greater than ten preceptorship\n\nrotations completed in a calendar year, and shall be equal to the\n\nfollowing amounts:\n\na. for a medical student or resident, Two Hundred Ninety\n\nDollars ($290.00) each for the first, second, or third\n\npreceptorship rotations and Five Hundred Ninety\n\nDollars ($590.00) each for up to seven subsequent\n\nrotations, and\n\nb. for a physician assistant student or advanced practice\n\nregistered nursing student, One Hundred Sixty-five\n\nDollars ($165.00) each for the first, second, or third\n\npreceptorship rotations and Three Hundred Forty\n\nDollars ($340.00) each for up to seven subsequent\n\nrotations.\n\nC. The credit authorized by this section shall not be used to\n\nreduce the tax liability of the taxpayer to less than zero (0).\n\nD. To the extent not used, the credits authorized by this\n\nsection may be carried over, in order, to each of the five (5)\n\nsubsequent tax years.\n\nE. The Health Care Workforce Training Commission shall award\n\nthe credit authorized by subsection B of this section to faculty\n\npreceptors for preceptorship rotations of:\n\n1. Medical students enrolled in a medical school in this state;\n\n2. Residents who are allopathic physicians pursuing\n\npostgraduate medical education at a program supported by a medical\nach of the five (5)\n\nsubsequent tax years.\n\nE. The Health Care Workforce Training Commission shall award\n\nthe credit authorized by subsection B of this section to faculty\n\npreceptors for preceptorship rotations of:\n\n1. Medical students enrolled in a medical school in this state;\n\n2. Residents who are allopathic physicians pursuing\n\npostgraduate medical education at a program supported by a medical\n\nschool in this state;\n\n3. Physician assistant students;\n\n4. Medical students enrolled in a school or college of\n\nosteopathic medicine in this state;\n\n5. Residents who are osteopathic physicians pursuing\n\npostgraduate medical education at a program supported by a school or\n\ncollege of osteopathic medicine in this state; and\n\n6. Advanced practice registered nursing students.\n\nF. 1. The credits awarded by the Health Care Workforce\n\nTraining Commission under paragraphs 1 and 2 of subsection E of this\n\nsection for the tax year shall not exceed the amount deposited to\n\nthe Physician Preceptor Tax Credit Revolving Fund created in Section\n\n2 of this act during the fiscal year ending on the June 30 date\n\nimmediately preceding the date upon which the applicable income tax\n\nyear begins.\n\n2. The credits awarded by the Health Care Workforce Training\n\nCommission under paragraph 3 of subsection E of this section for the\n\ntax year shall not exceed the amount deposited to the Physician\n\nAssistant Preceptor Tax Credit Revolving Fund created in Section 3\n\nof this act during the fiscal year ending on the June 30 date\n\nimmediately preceding the date upon which the applicable income tax\n\nyear begins.\n\n3. The credits awarded by the Health Care Workforce Training\n\nCommission under paragraphs 4 and 5 of subsection E of this section\n\nfor the tax year shall not exceed the amount deposited to the\n\nOsteopathic Physician Preceptor Tax Credit Revolving Fund created in\n\nSection 4 of this act during the preceding fiscal year ending on the\n\nJune 30 date immediately preceding the date upon which the\n\napplicable income tax year begins.\n\n4. The credits awarded by the Health Care Workforce Training\n\nCommission under paragraph 6 of subsection E of this section for the\n\ntax year shall not exceed the amount deposited to the Advanced\n\nPractice Registered Nurses Preceptor Tax Credit Revolving Fund\n\ncreated in Section 5 of this act during the preceding fiscal year\n\nending on the June 30 date immediately preceding the date upon which\n\nthe applicable income tax year begins.\n\nG. Partial claims for credit may be awarded. Credits earned\n\nbut not allowed due to the application of the limitation provided in\n\nthis section shall be considered suspended and authorized to be used\n\nin the subsequent tax year and applied to the next tax year’s\n\nlimitation.\n\nH. In order to receive the credit provided pursuant to this\n\nsection, a faculty preceptor shall:\n\n1. Claim the credit for the tax year in which the preceptorship\n\nrotation was completed;\n\n2. Certify that he or she did not receive payment during the\n\ntax year from any source for providing the training; and\n\n3. Supply supporting documentation as may be required by the\n\nHealth Care Workforce Training Commission.\n\nI. 1. The State Board of Medical Licensure and Supervision\n\nshall reserve Seven Dollars ($7.00) of every annual licensure fee\n\nreceived from allopathic physicians and shall deposit the sum to the\n\nPhysician Preceptor Tax Credit Revolving Fund created in Section 2\n\nof this act for the purpose of providing funding for the credit\n\nauthorized by this section.\n\n2. The State Board of Medical Licensure and Supervision shall\n\nreserve Four Dollars ($4.00) of every annual licensure fee received\n\nfrom physician assistants and shall deposit the sum to the Physician\n\nAssistant Preceptor Tax Credit Revolving Fund created in Section 3\n\nof this act for the purpose of providing funding for the credit\n\nauthorized by this section.\ncredit\n\nauthorized by this section.\n\n2. The State Board of Medical Licensure and Supervision shall\n\nreserve Four Dollars ($4.00) of every annual licensure fee received\n\nfrom physician assistants and shall deposit the sum to the Physician\n\nAssistant Preceptor Tax Credit Revolving Fund created in Section 3\n\nof this act for the purpose of providing funding for the credit\n\nauthorized by this section.\n\n3. The State Board of Osteopathic Examiners shall reserve Seven\n\nDollars ($7.00) of every annual licensure fee received from\n\nosteopathic physicians and shall deposit the sum to the Osteopathic\n\nPhysician Preceptor Tax Credit Revolving Fund created in Section 4\n\nof this act for the purpose of providing funding for the credit\n\nauthorized by this section.\n\n4. The Oklahoma Board of Nursing shall reserve Four Dollars\n\n($4.00) of every annual licensure fee received from Advanced\n\nPractice Registered Nurses and shall deposit the sum to the Advanced\n\nPractice Registered Nurses Preceptor Tax Credit Revolving Fund\n\ncreated in Section 5 of this act for the purpose of providing\n\nfunding for the credit authorized by this section.\n\nJ. 1. With respect to each tax year for which any tax credit\n\nauthorized by this section is awarded, the Health Care Workforce\n\nTraining Commission shall electronically submit information to the\n\nOklahoma Tax Commission, which shall include the number and amount\n\nof tax credits awarded and the name of the taxpayers that were\n\nawarded credits.\n\n2. With respect to each fiscal year the State Board of Medical\n\nLicensure and Supervision, the State Board of Osteopathic Examiners,\n\nand the Oklahoma Board of Nursing shall electronically submit to the\n\nHealth Care Workforce Training Commission and the Oklahoma Tax\n\nCommission the amount deposited in the Physician Preceptor Tax\n\nCredit Revolving Fund created in Section 2 of this act, the\n\nPhysician Assistant Preceptor Tax Credit Revolving Fund created in\n\nSection 3 of this act, the Osteopathic Physician Preceptor Tax\n\nCredit Revolving Fund created in Section 4 of this act, and the\n\nAdvanced Practice Registered Nurses Preceptor Tax Credit Revolving\n\nFund created in Section 5 of this act.\n\nK.
