Stat. tit. 68, § 68-3133","heading":"Prima facie evidence, resale tax deed as","body":"(a) A resale tax deed executed in substantial compliance with\n\nthe provisions of the preceding section shall be prima facie\n\nevidence in all courts of the state, and in all suits and\n\ncontroversies relating to the rights of the grantee named in said\n\ndeed, his heirs, successors or assigns, to the land thereby\n\nconveyed, of the following facts:\n\n(1) That the real property deeded was subject to taxation for\n\nthe year or years included in such sale;\n\n(2) That the property had been legally assessed for such year;\n\n(3) That the taxes were levied according to law;\n\n(4) That the said property was legally sold to the county at\n\ndelinquent tax sale more than two (2) years prior to said resale and\n\nthat the lien acquired by the county at such sale remained in the\n\ncounty;\n\n(5) That the property deeded had not been redeemed from sale at\n\nthe date of the deed;\n\n(6) That the property was legally sold at resale to the grantee\n\nnamed in said resale deed and was duly advertised before being sold;\n\n(7) That all proceedings, notices and duties provided, required\n\nand imposed by law prerequisite to the vesting of authority in the\n\ncounty treasurer to execute such deed had been followed, given,\n\ncomplied with and performed.\n\n(b) To defeat the deed it must be clearly pleaded and clearly\n\nproven that one or more of the essential prerequisites to the\n\nvesting of authority in said county treasurer to execute such deed\n\nwas wholly omitted and not done; and a showing that one or more of\n\nsaid prerequisites was irregularly done shall not be sufficient to\n\ndefeat the deed.","path":["OK Code","Title 68"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"73ef3851b455abed8ad73096bdb8df17aab4238ab7894931a2c9999db727cfcb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-68-68-3132","next":"us-ok/okla.-stat.-tit.-68-68-3134"},"notice":"GroundRules: Original legal text.
