Stat. tit. 68, § 68-3503","heading":"Definitions","body":"As used in this act:\n\n1. \"Qualified federal facility\" means a facility developed\n\nafter March 1, 1993, by or at the expense of a political subdivision\n\nof this state and leased or conveyed to the government of the United\n\nStates which primarily houses federal employees; provided, the\n\nannual gross payroll for new direct jobs of a qualified federal\n\nfacility must be projected by the Department of Commerce as having\n\nthe potential to equal or exceed Fifty Million Dollars\n\n($50,000,000.00) when the facility is fully operational;\n\n2. \"New direct job\" means full-time-equivalent employment in a\n\nqualified federal facility which did not exist in this state prior\n\nto the date of approval by the Department of Commerce of the\n\napplication of the political subdivision for the qualified federal\n\nfacility pursuant to the provisions of Section 4 of this act;\n\n3. \"Estimated direct state benefits\" means the tax revenues\n\nprojected by the Department of Commerce to accrue to the state as a\n\nresult of new direct jobs;\n\n4. \"Estimated direct state costs\" means the costs projected by\n\nthe Department of Commerce to accrue to the state as a result of new\n\ndirect jobs. Such costs shall include but not be limited to:\n\na. the costs of education of new state resident children,\n\nb. the costs of public health, public safety and\n\ntransportation services to be provided to new state\n\nresidents,\n\nc. the costs of other state services to be provided to\n\nnew state residents,\n\nd. the costs of employee training and other state\n\nservices, and\n\ne. the costs of physical infrastructure needed to support\n\nthe facility;\n\n5. \"Estimated net direct state benefits\" means the estimated\n\ndirect state benefits less the estimated direct state costs;\n\n6. \"Net benefit rate\" means the estimated net direct state\n\nbenefits computed as a percentage of gross payroll; provided, the\n\nnet benefit rate shall not exceed the lesser of five and one-fourth\n\npercent (5.25%) or the minimum rate deemed by the Department of\n\nCommerce to be necessary to result in an incentive payment at a\n\nlevel which will enable the political subdivision to attract the\n\nqualified federal facility;\n\n7. \"Political subdivision\" means a municipality, a county or a\n\npublic trust, the beneficiary or beneficiaries of which are a\n\nmunicipality, a county or the State of Oklahoma or a combination\n\nthereof;\n\n8. \"Gross payroll\" means wages for new direct jobs as defined\n\nin paragraph (e) of Section 2385.1 of Title 68 of the Oklahoma\n\nStatutes;\n\n9. \"Project term\" means the length of time a political\n\nsubdivision may receive incentive payments pursuant to the\n\nprovisions of this act; provided, the project term shall not exceed\n\ntwenty (20) years from the date of the first incentive payment;\n\n10. \"Total net benefit\" means the net benefit rate multiplied\n\nby the gross payroll over the project term as estimated by the\n\nDepartment of Commerce pursuant to the provisions of subsection C of\n\nSection 4 of this act; and\n\n11. \"Develop\" means acquire, maintain, construct, improve,\n\nenlarge, renew, renovate, replace, lease, equip, furnish or operate.","path":["OK Code","Title 68"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a9710bdf6669d579011e7d19a3d64d01e283e5f824d0166e0db4826bfea80bbb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-68-68-3502","next":"us-ok/okla.-stat.-tit.-68-68-3504"},"notice":"GroundRules: Original legal text.
