There is hereby created until July 1, 2045, an ROA-25\n\ninvestment rebate program for the cost of qualified capital\n\nexpenditures by establishments which create not less than a\n\nthreshold number of new direct jobs as provided in this section.\n\n2. The threshold number of new direct jobs required for\n\nestablishments to qualify and remain qualified for investment rebate\n\npayments created in paragraph 1 of this subsection shall be seven\n\nhundred (700) new direct jobs in year one of the rebate payment\n\nperiod, with a threshold number of one thousand (1,000) beginning in\n\nyear two and throughout the remainder of the rebate payment period.\n\nB. The ROA-25 investment rebate program shall be administered\n\nby the Oklahoma Department of Commerce.\n\nC. No later than October 1 of each year, the Oklahoma\n\nDepartment of Commerce shall submit electronically an annual report\n\nto the Speaker of the Oklahoma House of Representatives, the\n\nPresident Pro Tempore of the Oklahoma State Senate, the Chair of the\n\nAppropriations and Budget Committee of the Oklahoma House of\n\nRepresentatives, the Chair of the Appropriations Committee of the\n\nOklahoma State Senate, and the Executive Director of the Legislative\n\nOffice of Fiscal Transparency detailing the program and ROA-25\n\ninvestment rebate payments.\n\nD. The Oklahoma Department of Commerce and the State Treasurer\n\nmay promulgate rules to implement the provisions of this act.\n\nE. To be eligible for consideration for an ROA-25 investment\n\nrebate payment awarded under the provisions of this act, a primary\n\nestablishment shall:\n\n1. a. Submit an application and documentation to the\n\nOklahoma Department of Commerce, as required by the\n\nDepartment:\n\n(1) outlining a capital expenditure plan in this\n\nstate associated with qualified capital\n\nexpenditures totaling no less than Two Billion\n\nDollars ($2,000,000,000.00), and\n\n(2) outlining new job creation levels no less than\n\nseven hundred (700) new jobs, and\n\nb. Establishment primarily engaged under Industry Sector\n\nNos. 31 through 33 of the NAICS Manual, latest\n\nrevision;\n\n2. Be otherwise qualified to receive payments pursuant to the\n\nprovisions of the Oklahoma Quality Jobs Program Act created pursuant\n\nto Section 3601 of Title 68 of the Oklahoma Statutes; and\n\n3. Have filed all Oklahoma tax returns and tax documents\n\nrequired by law.\n\nF. 1. Notwithstanding any other provision of law, if a primary\n\nestablishment receives an ROA-25 investment rebate payment pursuant\n\nto the provisions of this act, neither the qualified establishment\n\nnor its subsidiaries shall be eligible to receive quarterly\n\nincentive payments provided for in Section 3601 et seq. of Title 68\n\nof the Oklahoma Statutes, in connection with the project or\n\ndevelopment for which the investment rebate payment was based.\n\n2. Notwithstanding any other provision of law, no investment\n\nexpenditure shall be utilized for calculation purposes in a way that\n\nresults in the qualification of more than one establishment under\n\nthe provisions of this act, for ROA-25 investment rebate payments\n\nbased on the same expenditure.\n\nG. 1. Except as limited by paragraph 2 of this subsection, the\n\nOklahoma Department of Commerce shall approve or disapprove claims\n\nfor rebates and issue ROA-25 investment rebate payments for all\n\napproved claims from funds held in the ROA-25 Beneficiary Revolving\n\nFund created pursuant to Section 5 of this act and subject to the\n\nlimitations set forth in Section 4 of this act.\n\n2.
