Stat. tit. 68, § 68-3653","heading":"Definitions","body":"As used in this act:\n\n1. \"Establishment\" means a business that:\n\na. has at least One Hundred Fifteen Million Dollars\n\n($115,000,000.00) in annual gross compensation paid\n\nwith respect to jobs located in Oklahoma according to\n\nOklahoma Employment Security records and company\n\nreports for the three (3) years prior to the\n\nirrevocable election filing date provided by Section\n\n3658 of this title,\n\nb. has an average salary of at least Forty Thousand\n\nDollars ($40,000.00) paid to employees as of the\n\nirrevocable election filing date provided by Section\n\n3658 of this title,\n\nc. intends to add substantial gross compensation, as\n\ndefined below, with respect to full-time-equivalent\n\nemployment located in Oklahoma within three (3) years\n\nof filing an initial irrevocable election with the\n\nOklahoma Department of Commerce pursuant to the\n\nprovisions of subsection A of Section 3658 of this\n\ntitle,\n\nd. has at least Two Hundred Million Dollars\n\n($200,000,000.00) total investment in Oklahoma,\n\ne. intends to add investment for additional modernization\n\nand retooling of a facility located in the state, on\n\nor after the effective date of this act, of at least\n\nOne Hundred Million Dollars ($100,000,000.00), but for\n\npurposes of this act not in excess of an additional\n\nSeven Hundred Million Dollars ($700,000,000.00) within\n\nfive (5) years of filing a second irrevocable election\n\nwith the Oklahoma Department of Commerce pursuant to\n\nthe provisions of subsection A of Section 3658 of this\n\ntitle, unless the establishment has completed at least\n\neighty percent (80%) of the expenditures for the\n\nadditional investment by the end of the five-year\n\nperiod in which case the establishment shall be\n\nallowed a one-year extension for completion of the\n\ninvestment,\n\nf. for purposes of an initial irrevocable election filed\n\nprior to the effective date of this act, has and\n\nmaintains at least one thousand five hundred fifty\n\n(1,550) full-time employees in the state, and\n\ng. is described by Industry Number 3011, Industry Group\n\nNumber 301, Major Group 30 of the Standard Industrial\n\nClassification Manual (SIC), latest revision;\n\n2. \"Gross compensation\" means wages, as defined in Section\n\n2385.1 of Title 68 of the Oklahoma Statutes, and benefits paid on\n\nbehalf of employees receiving wages; and\n\n3. \"Substantial gross compensation\" means annualized\n\ncompensation of Four Million Dollars ($4,000,000.00) or more within\n\nthree (3) years of filing the initial irrevocable election with the\n\nOklahoma Department of Commerce pursuant to Section 3658 of this\n\ntitle.","path":["OK Code","Title 68"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ee149d7b407a62a8252eb0d55a6ea3976d88e6a04644296283326e3188498f9d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-68-68-3652","next":"us-ok/okla.-stat.-tit.-68-68-3654"},"notice":"GroundRules: Original legal text.
