As used in the Oklahoma Remote Quality Jobs Incentive Act:\n\n1. \"Basic industry\" means an establishment that attracts remote\n\nworkers to the state whose purpose is to increase the state's\n\npopulation and who may receive rebates on the remote workers;\n\nprovided, that the remote workers meet the wage and health insurance\n\nrequirements in the state and provide evidence of such to the proxy\n\nestablishment;\n\n2. \"New direct job\" shall include full-time-equivalent\n\nemployment in this state of remote workers who are employed by an\n\nestablishment other than the proxy establishment which has qualified\n\nto receive incentive payments for attracting remote workers to the\n\nstate. Such jobs held by remote workers did not exist in this state\n\nprior to the date of approval by the Oklahoma Department of Commerce\n\nof the application of the proxy establishment. A job shall be\n\ndeemed to exist in this state prior to approval of an application if\n\nthe activities and functions for which the particular job exists\n\nhave been ongoing at any time within six (6) months prior to such\n\napproval;\n\n3. \"Proxy establishment\" means:\n\na. a public trust which:\n\n(1) is organized and existing under Section 176 of\n\nTitle 60 of the Oklahoma Statutes for the benefit\n\nof a geographic area which includes a city or\n\ncounty or some combination thereof, and\n\n(2) benefits a geographic area where new direct jobs\n\nwhich meet the requirements of the Oklahoma\n\nRemote Quality Jobs Incentive Act are created by\n\nan establishment, other than the proxy\n\nestablishment, or\n\nb. an establishment which facilitates the attraction of\n\nremote workers to the State of Oklahoma;\n\n4. \"Remote worker\" refers to a work flexibility arrangement\n\nunder which an employee performs the duties and responsibilities of\n\nsuch employee's position, and other authorized activities, from an\n\napproved work site other than the location from which the employee\n\nwould otherwise work, which shall not be located within the physical\n\nboundaries of the State of Oklahoma. The remote worker should not\n\nhave lived in the State of Oklahoma in the previous twelve (12)\n\nmonths;\n\n5. \"Estimated direct state benefits\" means the tax revenues\n\nprojected by the Department to accrue to the state as a result of\n\nnew direct jobs;\n\n6. \"Estimated direct state costs\" means the costs projected by\n\nthe Department to accrue to the state as a result of new direct\n\njobs. Such costs shall include, but not be limited to:\n\na. the costs of education of new state resident children,\n\nb. the costs of public health, public safety and\n\ntransportation services to be provided to new state\n\nresidents,\n\nc. the costs of other state services to be provided to\n\nnew state residents, and\n\nd. the costs of other state services;\n\n7. \"Estimated net direct state benefits\" means the estimated\n\ndirect state benefits less the estimated direct state costs; and\n\n8. \"Net benefit rate\" means the estimated net direct state\n\nbenefits computed as a percentage of gross payroll, and shall not\n\nexceed five percent (5%).\n\nB. A proxy establishment shall be required to obtain from\n\nremote workers proof of basic health benefits plans for the\n\nindividuals it includes in an application. The proxy establishment\n\nshall submit the information to the Oklahoma Department of Commerce\n\nand shall ensure that the basic health benefits plans provide\n\ncoverage where not more than fifty percent (50%) of the premium\n\nshall be paid by the employee; however, services provided by an\n\nEmployee Assistance Plan (EAP) are not sufficient to meet this\n\ndefinition.","path":["OK Code","Title 68"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"db7f92eb81a8b2ab38160068a712550575b2f1e2c6f38dabed63cf732d255356","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-68-68-4502","next":"us-ok/okla.-stat.-tit.-68-68-4504"},"notice":"GroundRules: Original legal text.
