Each person operating a refinery, terminal, or bulk plant in\n\nthis state shall prepare and provide to the driver of every fuel\n\ntransportation vehicle receiving motor fuel into the vehicle storage\n\ntank at the facility a shipping document setting out on its face:\n\n1. Identification by address of the terminal or bulk plant from\n\nwhich the motor fuel was removed;\n\n2. The date the motor fuel was removed;\n\n3. The amount of motor fuel removed, actual gallons and net\n\ngallons;\n\n4. The state of destination as represented to the terminal\n\noperator by the transporter, the shipper or the agent of the\n\nshipper; and\n\n5. Any other information reasonably required by the Commission\n\nfor the enforcement of this act.\n\nB. A terminal operator may manually prepare shipping papers if\n\nthe terminal does not have the ability to prepare automated shipping\n\npapers or as a result of extraordinary unforeseen circumstances,\n\nincluding acts of God, which temporarily interfere with the ability\n\nof the terminal operator to issue automated machine-generated\n\nshipping papers. However, the terminal operator shall, prior to\n\nmanually preparing the papers, provide, in the case of a terminal\n\nnot having the ability to prepare automated shipping papers, written\n\nnotice to the Commission, or in the case of extraordinary\n\ncircumstances, telephonic notice to the Commission and obtain a\n\nservice interruption authorization number which the employees of the\n\nterminal operator shall add to the manually prepared papers prior to\n\nremoval of each effected transport load from the terminal. The\n\nservice interruption authorization number shall be valid for use by\n\nthe terminal operator for a period not to exceed twenty-four (24)\n\nhours. If the interruption has not been cured within the twenty-\n\nfour-hour period, additional notice(s) to the Commission shall be\n\nrequired and interruption authorization number(s) may be issued upon\n\nexplanation by the terminal operator satisfactory to the Commission.\n\nIf the terminal operator acquires the ability to prepare automated\n\nmachine-printed shipping papers, the terminal operator shall notify\n\nthe Commission no later than ten (10) days prior to the initial use\n\nof such capability.\n\nC. An operator of a bulk plant in this state delivering motor\n\nfuel into a tank wagon for subsequent delivery to a consumer in this\n\nstate shall be exempt from this section. An operator of a bulk\n\nplant in this state shall not be required to identify net gallons on\n\nthe shipping documents as provided by this section.\n\nD. A terminal operator may load motor or diesel fuel, a portion\n\nof which fuel is destined for sale or use in this state and a\n\nportion of which fuel is destined for sale or use in another state\n\nor states. However, such split loads removed shall be documented by\n\nthe terminal operator by issuing shipping papers designating the\n\nstate of destination for each portion of the fuel.\n\nE. Each terminal operator shall post a conspicuous notice\n\nproximately located to the point of receipt of shipping papers by\n\ntransport truck operators, which notice shall describe in clear and\n\nconcise terms the duties of the transport operator and retail dealer\n\nunder Section 45 of this act, provided that the Commission may by\n\nrule or notice establish the language, type, style and format of the\n\nnotice.\n\nF. A person who knowingly violates or knowingly aids and abets\n\nanother to violate this section with the intent to evade the tax\n\nlevied by this act shall be guilty of a misdemeanor and shall, upon\n\nconviction, be fined not more than One Thousand Dollars ($1,000.00),\n\nor be sentenced to a term of not more than one (1) year in the\n\ncounty jail, or shall be punishable by both such fine and\n\nimprisonment.","path":["OK Code","Title 68"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4ce5f8dd23b5e1a40a51ade8d241737e3cd036763d9839eb897c61a688178742","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-68-68-500.43","next":"us-ok/okla.-stat.-tit.-68-68-500.45"},"notice":"GroundRules: Original legal text.
