Except as provided in subsections C and D of this section,\n\nno person shall operate a transport truck that is engaged in the\n\nshipment of motor fuel on the public highways of this state without\n\nhaving on board a terminal-issued shipping paper bearing, in\n\naddition to the requirements of subsection A of Section 45 of this\n\nact, a notation indicating that, with respect to diesel fuel\n\nacquired under claim of exempt use, a statement indicating the fuel\n\nis \"DYED DIESEL FUEL, NONTAXABLE USE ONLY, PENALTY FOR TAXABLE USE\"\n\nfor the load or the appropriate portion of the load.\n\nB. A person is in violation of subsection A of this section\n\nupon boarding the vehicle with a shipping paper which does not meet\n\nthe requirements set forth in this section.\n\nC. The Commission may in its discretion provide an advance\n\nnotification procedure with respect to documentation for imported\n\nmotor fuel as to which the importer is unable to obtain terminal-\n\nissued shipping papers which comply with this section.\n\nD. Any person who knowingly violates any part of this section\n\nshall be guilty of a misdemeanor and shall, upon conviction, be\n\nfined not more than One Thousand Dollars ($1,000.00), or be\n\nsentenced to a term of not more than six (6) months in the county\n\njail, or shall be punishable by both such fine and imprisonment.\n\nE.
