The Commission, or its appointees, including federal\n\ngovernment employees or persons operating under contract with the\n\nstate, upon presenting appropriate credentials may conduct\n\ninspections and remove samples of fuel to determine coloration of\n\ndiesel fuel, or to identify shipping paper violations at any place\n\nwhere taxable fuel is or may be produced, stored or loaded into\n\ntransport vehicles. Inspections shall be performed in a reasonable\n\nmanner consistent with the circumstances, but in no event is prior\n\nnotice required. Inspectors may physically inspect, examine or\n\notherwise search any tank, reservoir, or other container that can or\n\nmight be used for the production, storage, or transportation of\n\nfuel. Inspection may be made of any equipment used for, or in\n\nconnection with, the production, storage, or transportation of fuel.\n\nInspectors may demand to be produced for immediate inspection the\n\nshipping papers, documents and records required to be kept by a\n\nperson transporting fuel. The places which may be inspected\n\npursuant to this section may include, but are not limited to:\n\n1. A terminal;\n\n2. A fuel storage facility that is not a terminal;\n\n3. A retail fuel facility;\n\n4. Highway rest stops; or\n\n5. A designated inspection site. For purposes of this section,\n\na \"designated inspection site\" means any state highway or waterway\n\ninspection station, weigh station, agricultural inspection station,\n\nmobile station, or other location designated by the Commission\n\neither fixed or mobile.\n\nB. Inspections to determine violations under this act may be\n\nconducted by the Department of Public Safety, agents of the\n\nCommission, Oklahoma Corporation Commission, motor carrier\n\ninspectors in this state in addition to their duties otherwise\n\ndefined, and any other law enforcement officer through procedures\n\nestablished by the Commission. Agents of the Commission have the\n\nsame power and authority provided to authorized personnel under the\n\napplicable statute.\n\nC. Inspectors may reasonably detain any person or equipment\n\ntransporting fuel in or through this state for the purpose of\n\ndetermining whether the person is operating in compliance with the\n\nprovisions of this act and any rules promulgated pursuant to this\n\nact.
