Upon July 1, 2022, there is hereby created the Oklahoma\n\nEmission Reduction Technology Rebate Program. There is hereby\n\ncreated a rebate in the amount of up to twenty-five percent (25%) of\n\ndocumented expenditures made in this state directly attributable to\n\nthe implementation of a qualified Emission Reduction Project.\n\nB. The rebate program shall be administered by the Department\n\nof Environmental Quality and the Oklahoma Tax Commission, as\n\nprovided in the Oklahoma Emission Reduction Technology Incentive\n\nAct.\n\nC. To be eligible for a rebate payment:\n\n1. The applicant responsible for the implementation of a\n\nqualified Emission Reduction Project in this state shall submit\n\ndocumentation to the Department of Environmental Quality no later\n\nthan six (6) months after the end of the fiscal year in which the\n\nimplementation of the qualified Emission Reduction Project was\n\ncompleted, stating the amount of expenditures made in this state\n\ndirectly related to the implementation of the qualified Emission\n\nReduction Project; provided, all applications for rebate payment\n\nshall be submitted to the Department no later than six (6) months\n\nprior to the date of cessation of the Oklahoma Emission Reduction\n\nTechnology Rebate Program, as provided in Section 55012 of this\n\ntitle. The Department of Environmental Quality shall additionally\n\nestablish a process whereby an applicant may submit a rebate payment\n\napplication for preliminary review and approval prior to the\n\nexpenditure of project funds. Any approval through this alternative\n\nprocess shall be subject to final approval as determined necessary\n\nby the Department of Environmental Quality;\n\n2. The applicant has filed all Oklahoma tax returns and tax\n\ndocuments which are required by the laws of this state; and\n\n3. The applicant shall provide evidence of a certificate of\n\ngeneral liability insurance with a minimum coverage of One Million\n\nDollars ($1,000,000.00) and a workers’ compensation policy pursuant\n\nto the laws of this state which shall include coverage of employer’s\n\nliability.\n\nD. The Department of Environmental Quality shall approve or\n\ndisapprove all claims for a rebate payment and shall notify the\n\nOklahoma Tax Commission. The Tax Commission shall, upon\n\nnotification of final approval from the Department of Environmental\n\nQuality, issue a rebate payment for all approved claims from funds\n\nin the Oklahoma Emission Reduction Technology Upstream and Midstream\n\nIncentive Revolving Fund and the Oklahoma Emission Reduction\n\nTechnology Downstream Incentive Revolving Fund, both created in\n\nSection 55010 of this title. If the amount of the approved claims\n\nexceeds the amount available in either fund, during a fiscal year,\n\npayments shall be made proportionally to all the parties making a\n\nclaim prior to the deadline which is approved by the Department of\n\nEnvironmental Quality.\n\nE. Approved claims for rebate that exceed the balance of the\n\nOklahoma Emission Reduction Technology Upstream and Midstream\n\nIncentive Revolving Fund and the Oklahoma Emission Reduction\n\nTechnology Downstream Incentive Revolving Fund, both created in\n\nSection 55010 of this title, may be paid in part and the unpaid\n\nportion shall be paid upon the applicable fund reaching a sufficient\n\nbalance in the order in which the claims are approved by the\n\nDepartment.","path":["OK Code","Title 68"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8d69ec1b1f72cf9a18b2711484050e3d13ecc6a77962582da1c55b20899d55fc","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-68-68-55008","next":"us-ok/okla.-stat.-tit.-68-68-55010"},"notice":"GroundRules: Original legal text.
