There is hereby created in the State Treasury a revolving\n\nfund for the Oklahoma Tax Commission to be designated the \"Oklahoma\n\nEmission Reduction Technology Upstream and Midstream Incentive\n\nRevolving Fund\". The fund shall be a continuing fund, not subject\n\nto fiscal year limitations, and shall consist of all monies received\n\nby the Tax Commission from any public or private donations,\n\ncontributions, and gifts received for the benefit of the fund and\n\nany amounts appropriated by the Legislature designated for deposit\n\nin the fund. All monies accruing to the credit of the fund are\n\nhereby appropriated and may be budgeted and expended by the Tax\n\nCommission for the purpose of paying rebates for emission reduction\n\nprojects, except for projects pertaining to refining activities, as\n\nprovided in the Oklahoma Emission Reduction Technology Incentive\n\nAct. Expenditures from the fund shall be made upon warrants issued\n\nby the State Treasurer against claims filed as prescribed by law\n\nwith the Director of the Office of Management and Enterprise\n\nServices for approval and payment. Any remaining unencumbered\n\nbalance upon the cessation of the Oklahoma Emission Reduction\n\nTechnology Rebate Program, as provided in Section 55012 of this\n\ntitle, shall be transferred to the General Revenue Fund of this\n\nstate.\n\nB. There is hereby created in the State Treasury a revolving\n\nfund for the Oklahoma Tax Commission to be designated the \"Oklahoma\n\nEmission Reduction Technology Downstream Incentive Revolving Fund\".\n\nThe fund shall be a continuing fund, not subject to fiscal year\n\nlimitations, and shall consist of all monies received by the Tax\n\nCommission from any public or private donations, contributions, and\n\ngifts received for the benefit of the fund and any amounts\n\nappropriated by the Legislature designated for deposit in the fund.\n\nAll monies accruing to the credit of the fund are hereby\n\nappropriated and may be budgeted and expended by the Tax Commission\n\nfor the purpose of paying rebates for emission reduction projects\n\npertaining to refining activities as provided in this act.\n\nExpenditures from the fund shall be made upon warrants issued by the\n\nState Treasurer against claims filed as prescribed by law with the\n\nDirector of the Office of Management and Enterprise Services for\n\napproval and payment.
