As used in this section:\n\n1. \"Highway emergency\" means a situation or condition of a\n\ndesigned state highway that:\n\na. poses a threat to life or property of travelers, or\n\nb. substantially disrupts the orderly flow of traffic and\n\ncommerce; and\n\n2. \"Highway improvement contract\" means a contract awarded by\n\nthe Department of Transportation for the construction, repair, or\n\nmaintenance of a designated state highway or any part of the\n\nhighway.\n\nB. As the part of any bidding procedure as provided by law for\n\nthe letting of contracts by the Department of Transportation, the\n\nDepartment may award a highway improvement contract in a highway\n\nemergency in accordance with rules adopted by the Department which\n\nmay include:\n\n1. Contractor eligibility;\n\n2. Notification of prospective bidders;\n\n3. Bidding requirements;\n\n4. Procedures for awarding the contract, pursuant to the Public\n\nCompetitive Bidding Act of 1974;\n\n5. Bonding or other requirements to ensure satisfactory\n\nperformance by the contractor and the protection of claimants\n\nsupplying labor and materials used in performance of the contract;\n\n6. Contract form and contents;\n\n7. Provisions for extended work days to expedite the\n\nimprovement; and\n\n8. Provisions for waiver of or exception to a procedure or\n\nrequirement adopted pursuant to this section.\n\nC. Prior to awarding a contract under this section, the\n\nDepartment shall certify in writing a description of the highway\n\nemergency. A copy of the certification of the highway emergency\n\nshall be attached to the contract. The Transportation Commission\n\nshall be sent a copy of the certification of the highway emergency\n\nfor final approval.\n\nD.
