All section lines in the state which are opened and\n\nmaintained by the board of county commissioners or the Department of\n\nTransportation for public use are hereby declared public highways.\n\nAll section lines that are not so opened and maintained for public\n\nuse may, by resolution of board, on the petition of the owner or all\n\nthe owners of the abutting land, after public notice and at the\n\nexpense of petitioner, be designated \"reserved section lines\" and\n\nare in the full and complete control of the owner or owners of the\n\nabutting land until such time as the board of county commissioners,\n\nby resolution, stating imminent intended use for public highway\n\npurposes, and by ninety-day written notice to the owner or owners of\n\nthe abutting land, revoke said \"reserved section lines\" status.\n\nProvided, however, that no section line may be placed in reserve\n\nstatus unless the full width of such section line is so treated and\n\nno fee owner shall be denied the right of ingress and egress to his\n\nland by virtue of this act. Whenever a section line is a boundary\n\nline between two counties, action by boards of county commissioners\n\nof both counties will be necessary to place a section line in\n\n\"reserve status.\"\n\nB. Neither a board of county commissioners nor the Department\n\nof Transportation shall open a public highway, take any action to\n\nopen a public highway, or incur any of the costs necessary to open,\n\nconstruct or maintain a public highway pursuant to subsection A of\n\nthis section or pursuant to Section 601 et seq. of this title, upon\n\na segment of section line located within a county which is not then\n\nalready open and in use as a public highway or which is not then in\n\nreserve status as provided for in subsection A of this section, and\n\nwhere all of the following three circumstances exist, the\n\nLegislature hereby finding that through access by the public would\n\nnot be possible on the segment of section line even if a public\n\nhighway were constructed thereon:\n\n1. a. the land crossed by the segment of section line is\n\nlocated within the original boundaries of a facility\n\npreviously owned and operated by the United States of\n\nAmerica or a department or agency thereof which was\n\nsubsequently conveyed by the United States of America\n\nor said department or agency thereof to a public trust\n\nhaving the State of Oklahoma or one or more units of\n\ncounty or city government as its beneficiary, or\n\nb. the land crossed by the segment of section line is\n\nlocated within the boundaries of property proposed for\n\nconstruction of a new or expanded business facility.\n\nThe business shall make a minimum capital investment\n\nof Ten Million Dollars ($10,000,000.00) in the stated\n\nfacility and hire twenty-five new employees whose\n\nsalaries meet or exceed the average county wage where\n\nthe project is located;\n\n2. Any one or more of the owners of any portion of the land on\n\nboth sides of the entire section line has failed to request or\n\nconsent to the opening of a public highway on said segment of\n\nsection line or any portion thereof; and\n\n3. The segment of section line is blocked at one or both ends\n\nthereof by an impassable barrier, such as a river, one or more\n\noperating airport runways or taxiways, or security fencing, gates or\n\nbarricades erected in connection therewith, or by an operating rail\n\nline which does not have a section line highway crossing.\n\nC.
