Stat. tit. 69, § 69-1208","heading":"Structures in right-of-way or street prohibited - Public","body":"nuisance.\n\nA. The rights-of-way acquired by the Department of\n\nTransportation or a county shall be held inviolate for state\n\nhighway, departmental, or county purposes, and no physical or\n\nfunctional encroachments or uses shall be permitted within such\n\nrights-of-way.\n\nB. It shall be unlawful for any person to construct, maintain\n\nor operate any gasoline pump, driveway canopy, building, sign,\n\nfence, post, or any thing or structure on or overhanging any right-\n\nof-way, or upon or overhanging any street occupied by a designated\n\nstate or federal highway, or county roads and the construction or\n\nmaintaining of any such thing or structure on or overhanging any\n\nfederal or state highway or county roads shall constitute a public\n\nnuisance, which may be summarily abated by the Commission or board\n\nof county commissioners or its officers, agents, servants and\n\nemployees in the manner provided in this article.\n\nC. This section shall not apply to the lawful use of such\n\nrights-of-way for the erection and operation of facilities of a\n\npublic utility, or companies engaged in the activities defined in\n\nSection 137.1 of Title 52 of the Oklahoma Statutes.\n\nD. This section shall not apply to the placement, by the county\n\ncommissioners or the board of directors of a fire protection\n\ndistrict or the designees of either, of signage indicating that\n\nrestrictions on outdoor burning are in effect pursuant to Section\n\n901.8 of Title 19 of the Oklahoma Statutes. Such signage may be\n\nplaced on the right-of-way, provided such placement is made in\n\ncoordination with the Department of Transportation.
