Stat. tit. 69, § 69-1253","heading":"Definitions","body":"As used in this act:\n\n(a) \"Junk\" means old or scrap copper, brass, rope, rags,\n\nbatteries, paper, trash, rubber debris, waste, or junked, dismantled\n\nor wrecked automobiles, or parts thereof, iron, steel, and other old\n\nor scrap ferrous or nonferrous material.\n\n(b) \"Automobile graveyard\" means any establishment or place of\n\nbusiness which is maintained, used or operated for storing, keeping,\n\nbuying or selling wrecked, scrapped, ruined or dismantled motor\n\nvehicles or motor vehicle parts.\n\n(c) \"Junkyard\" means an establishment or place of business which\n\nis maintained, operated or used for storing, keeping, buying or\n\nselling junk, or for the maintenance or operation of an automobile\n\ngraveyard, and the term shall include garbage dumps and sanitary\n\nfills.\n\n(d) \"Interstate system\" means that portion of the National\n\nSystem of Interstate and Defense Highways located within this state,\n\nas officially designated, or as may hereafter be so designated by\n\nthe Transportation Commission, and approved by the Secretary of\n\nTransportation, pursuant to the provisions of Title 23, United\n\nStates Code, \"Highways.\"\n\n(e) \"Primary system\" means that portion of connected main\n\nhighways as officially designated, or as may hereafter be so\n\ndesignated, by the Transportation Commission, and approved by the\n\nSecretary of Transportation, pursuant to the provisions of Title 23,\n\nUnited States Code, \"Highways.\"\n\n(f) \"Unzoned industrial areas\" means any area not zoned by state\n\nor local law, regulation or ordinance, which is occupied by one or\n\nmore industrial activities, and the lands along the highway for a\n\ndistance of one thousand (1,000) feet measured in each direction\n\nfrom the outer edges of the regularly used buildings, parking lots,\n\nstorage, or processing areas of the activities, and lying parallel\n\nto the edge or pavement of the highway, and located on the same side\n\nof the highway as the principal part of said activities.\n\nMeasurements shall not be from the property lines of the activities,\n\nunless said property lines coincide with the limits of the\n\nactivities.\n\n(g) \"Scrap metal processing facility\" means an establishment\n\nhaving facilities used primarily for processing iron, steel or\n\nnonferrous metals and whose principal product is such iron, steel or\n\nscrap for sale for remelting purposes only, the processor being\n\nconsidered a manufacturer.\n\n(h) \"Industrial activities\" means those activities permitted\n\nonly in industrial zones, or in less restrictive zones by the\n\nnearest zoning authority within the state, or prohibited by said\n\nauthority but generally recognized as industrial by other zoning\n\nauthorities within the state except that none of the following shall\n\nbe considered industrial activities:\n\n(1) Outdoor advertising signs, displays or devices;\n\n(2) Agricultural, forestry, ranching, grazing, farming and\n\nrelated activities, including, but not limited to, wayside fresh\n\nproduce stands;\n\n(3) Activities normally and regularly in operation less than\n\nthree (3) months of the year;\n\n(4) Transient or temporary activities;\n\n(5) Activities not visible from the traffic lanes of the main\n\ntraveled way;\n\n(6) Activities more than three hundred (300) feet from the\n\nnearest edge of the main traveled way;\n\n(7) Activities conducted in a building principally used as a\n\nresidence;\n\n(8) Railroad tracks, minor sidings and passenger depots;\n\n(9) Strip or other open mining activities; and\n\n(10) Junkyards, automobile graveyards or scrap metal processing\n\nfacilities.\n\n(i) \"Department\" means the Oklahoma Department of\n\nTransportation.\n\n(j) \"Commission\" means the Transportation Commission of the\n\nOklahoma Department of Transportation.\n\n(k) \"Director\" means the Director of the Oklahoma Department of\n\nTransportation.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0cec168bbd4cfbc5fe0fdeec3de2549bbca2c72bbcf1d7026c50f4149117e962","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1252","next":"us-ok/okla.-stat.-tit.-69-69-1254"},"notice":"GroundRules: Original legal text.
