Stat. tit. 69, § 69-1276","heading":"Agreements with Secretary of Transportation","body":"The Department on behalf of the state shall seek agreement to\n\nthe provisions of Sections 4 and 5 of this act by the Secretary of\n\nTransportation on the basis of their being consistent with federal\n\nlaws and customary usages and zoning principles and standards which\n\nhold and govern in this state. In the event such an agreement\n\ncannot be achieved, this legislation shall be returned to the\n\nlegislative bodies of the State of Oklahoma for remedial action and\n\nresubmission to the Secretary. In the event such a new agreement\n\ncannot be achieved, the Department shall promptly institute\n\nproceedings of the kind provided for in Title 23 U.S.C.A. 131 (1) in\n\norder to obtain a judicial determination as to whether this chapter\n\nand the regulations promulgated thereunder provide effective control\n\nof outdoor advertising as set forth therein. In such action the\n\nDepartment shall request that the court declared rights, status and\n\nother legal relations and declare whether the standards, criteria\n\nand definitions contained in the agreement proposed by the\n\nDepartment are consistent with customary use. If such agreement is\n\nheld by the court in a final judgment to be invalid in whole or in\n\npart as inconsistent with customary use or is otherwise in conflict\n\nwith Title 23 U.S.C.A. 131, the Department shall promptly negotiate\n\nwith the Secretary of Transportation, or his successor, a new\n\nagreement or agreements which shall conform to said statute as\n\ninterpreted by the court in such action.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d5b1d2c434a04ef70dbd6e2d73450f6daffded0e2006d43f1588cc4dd14c2e2d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1275","next":"us-ok/okla.-stat.-tit.-69-69-1277"},"notice":"GroundRules: Original legal text.
