Outdoor advertising and property rights pertaining thereto\n\nmay be acquired by the Department of Transportation under agreement\n\nbetween the Department, the owner of the outdoor advertising and the\n\nowner of the land upon which the outdoor advertising is located if\n\nthe outdoor advertising is lawfully in existence pursuant to\n\nSections 1274 and 1275 of this title and located within areas\n\nprohibited to advertising by the Highway Advertising Control Act of\n\n1968. The compensation must be based on fair market value.\n\nB. Outdoor advertising is a trade fixture, and owners shall be\n\nawarded just and fair compensation for its taking.\n\nC. If the Department and the owners are unable to agree upon\n\nthe amount of compensation to be paid by the Department, the\n\nDepartment may acquire by condemnation such outdoor advertising and\n\nproperty rights pertaining thereto. This right of eminent domain or\n\ncondemnation shall be exercised in the manner provided by law.\n\nD. Any outdoor advertising authorized under Sections 1274 and\n\n1275 of this title which does not conform with standards set forth\n\nin Sections 1274 and 1275 of this title except as provided in\n\nSection 1278 of this title, and any outdoor advertising prohibited\n\nby law and not subject to compensation under other terms of this\n\nsection shall be a public nuisance. The Department shall give\n\nnotice by certified mail to the owner of the sign and to the owner\n\nof the land upon which the outdoor advertising is located, ordering\n\nthe notified owners to cause the outdoor advertising to conform with\n\nrules relating to outdoor advertising or to remove prohibited\n\noutdoor advertising. If the owner of the sign or the landowner\n\nfails to act within ninety (90) days after mailing of the notice,\n\nthe Department may, at its discretion, remove the outdoor\n\nadvertising device.\n\nE. All persons or business entities engaged in the outdoor\n\nadvertising business, which includes but is not limited to, the\n\nerection, maintenance and selling of advertising space on and along\n\nthe interstate and federal-aid primary highways of this state,\n\nshall, not later than October 31, 1972, furnish the Director of the\n\nDepartment of Transportation a written inventory of all outdoor\n\nadvertising signs, displays or devices erected and being maintained\n\nby the person or entity. The inventory shall include, with respect\n\nto each such sign, not less than the following information:\n\n1. Location and dimensions of the sign;\n\n2. Distance from the nearest edge of the right-of-way;\n\n3. Date erected; and\n\n4. Name and address of the owner of the property on which the\n\nsign is located.\n\nF. For failure to comply with the conditions set forth in\n\nsubsection E of this section, the Department may declare such\n\noutdoor advertising signs, displays or devices to be a public\n\nnuisance and remove them in the manner provided by subsection D of\n\nthis section.\n\nG. Regardless of any local ordinance requiring amortization,\n\nthe compensation provided in subsections A through C of this section\n\nand subsections (a) through (d) of Section 1279 of this title shall\n\nbe the exclusive remedy for taking such outdoor advertising and\n\nproperty rights pertaining thereto. Such compensation shall also be\n\nrequired for the partial taking or diminishment of the value of such\n\noutdoor advertising and property right caused by any local ordinance\n\nwhich forces the owners of such outdoor advertising to downsize,\n\nreduce the height or width or otherwise alter legal nonconforming\n\nsigns.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"71f053b1fff2d802d6d6366e45d8439d15ac3fd9cbb9236606b4dc57f47bb9a8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1279","next":"us-ok/okla.-stat.-tit.-69-69-1281"},"notice":"GroundRules: Original legal text.
