Stat. tit. 69, § 69-1305","heading":"Local benefits","body":"(a) When the governing body of a city or the board of county\n\ncommissioners of a county deems that local benefits accrue to any\n\nproperty served by such proposed limited access facility, it shall\n\nby resolution determine the amount or percentage of cost thereof to\n\nbe paid for by special assessment upon the benefited property, and\n\nby resolution shall require the city or county engineer, or\n\nconsulting engineer, to prepare plans, profiles, specifications and\n\nestimates of the probable cost of the improvements, including\n\nacquisition, and also including such expenses and cost as may be\n\nnecessary or essential to the completion of the limited access\n\nfacility. The estimate of cost shall be on a unit basis.\n\n(b) The resolution shall also define the boundaries or extent of\n\nthe district or lands to be specially assessed to pay all or that\n\npart of the cost so determined to be so assessed. The district\n\nshall be defined by stating with particularity the exterior\n\nboundaries thereof, which in no event shall be in excess of two\n\nthousand six hundred forty (2640) feet from the center line of the\n\nproposed limited access facility, to be included in the assessment\n\ndistrict, and which shall govern for all details as to the size and\n\nextent thereof.\n\n(c) The engineer preparing the report shall appear at the\n\nhearing thereon and give all information to all interested parties\n\nand to the governing body of the city or the board of county\n\ncommissioners.
