Stat. tit. 69, § 69-1310","heading":"Resolution for ordering improvement","body":"\n\n(a) After the expiration of time for objection on the part of\n\nthe property owners, or if insufficient protest is filed, the\n\ngoverning body of the city or the board of county commissioners\n\nshall adopt a resolution determining that no protest has been filed,\n\nor that such protest, if filed, was insufficient, and expressing the\n\ndetermination of the governing body or board to proceed with the\n\nacquisition or construction, or both, of the limited access\n\nfacility.\n\n(b) The resolution shall state that the facility will be\n\nacquired or constructed, or both, in accordance with the plans,\n\nprofiles and specifications theretofore adopted therefor, and shall\n\nstate the material to be used in the construction thereof.\n\n(c) The resolution shall set forth any reasonable terms or\n\nconditions that the governing body or the board shall determine\n\nproper with reference to letting the contract and the provisions\n\nthereof and shall provide that the contractor shall furnish, from\n\ntime to time thereafter, as required by the governing body or board\n\nof county commissioners, such funds, in cash, as are by the city or\n\ncounty needed in its condemnation proceedings in the acquisition of\n\nthe necessary sites and rights-of-way.\n\n(d) The resolution shall provide that the contractor shall\n\nexecute to the city or to the county good and sufficient bonds, in\n\nthe amount to be stated in the resolution, for the faithful\n\nfurnishing of such condemnation monies and also conditioned for the\n\nfull and faithful execution of the work and the performance of the\n\ncontract, and a further bond for the maintenance in good condition\n\nof such facility for a period of not less than five (5) years from\n\nthe date of its completion.\n\n(e) The resolution shall also require the execution of a good\n\nand sufficient bond to the State of Oklahoma conditioned on the\n\npayment of all labor and material used in the construction of the\n\nfacility in the full amount of the contract price thereof.\n\n(f) The resolution shall also direct the city or county clerk to\n\nadvertise for sealed proposals for furnishing the materials and\n\nperforming the work necessary in the construction of the facility.\n\nThe notice for such proposals shall state the time and place where\n\nthe same will be considered by the governing body or the board of\n\ncounty commissioners and shall be published in two consecutive\n\nThursday issues of a daily newspaper or two consecutive issues of a\n\nweekly newspaper published in the county and of general circulation\n\nin the city or county.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bec4ea58602531b905daf2a521a19e14aa6a0364949924d91685e5e6d0070b61","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1309","next":"us-ok/okla.-stat.-tit.-69-69-1311"},"notice":"GroundRules: Original legal text.
