Stat. tit. 69, § 69-1328","heading":"Setting aside assessments - Limitations","body":"(a) No suit shall be sustained to set aside any assessment or to\n\nenjoin the governing body of any city or the board of county\n\ncommissioners from levying or collecting any such assessment or\n\ninstallment thereof or interest or penalty thereon, or issuing the\n\nbonds, or providing for their payment or contesting the validity\n\nthereof on any ground, or for any reason, other than for failure of\n\nsuch governing body or such board to adopt and publish the\n\nresolution declaring the necessity for the improvements and\n\npublication thereof, and to give notice of the hearing on the return\n\nof the appraisers unless the suit shall be commenced not more than\n\nfifteen (15) days after the date of the last publication of the\n\nordinance levying assessments.\n\n(b) No suit shall be sustained after the work has been completed\n\nand accepted by the city or county except for failure to give such\n\nnotice of the preliminary resolution of necessity or failure to give\n\nthe notice of the hearing on such return of the appraisers.\n\n(c) However, in the event any special assessment shall be found\n\nto be invalid or insufficient in whole or in part, for any reason\n\nwhatever, the governing body or board of county commissioners may at\n\nany time in such manner provided for levying an original assessment\n\nproceed to cause a new assessment to be made and levied, which shall\n\nhave like force and effect as an original assessment.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5ba3e9ded61450ea4463ab04dedab87f1d9f98cea6f68a55b99485e887267835","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1327","next":"us-ok/okla.-stat.-tit.-69-69-1329"},"notice":"GroundRules: Original legal text.
