Stat. tit. 69, § 69-1704","heading":"Definitions - Concession contracts or leases","body":"As used in this article, the following words and terms shall\n\nhave the following meanings, unless the context shall indicate\n\nanother or different meaning or intent:\n\n1. \"Authority\" means the Oklahoma Turnpike Authority, created\n\nby Section 1703 of this title, or, if such Authority shall be\n\nabolished, the board, body, or commission succeeding to the\n\nprincipal functions thereof or to whom the powers given by this\n\narticle to the Authority shall be given by law;\n\n2. “Project” or \"turnpike project\" means any express highways,\n\nsuperhighways, or motorways, wayports, aviation transfer centers or\n\naviation hubs constructed under the provisions of this article by\n\nthe Authority, and shall embrace all bridges, tunnels, overpasses,\n\nunderpasses, interchanges, entrance plazas, approaches, free access\n\nroads, bridges, and road construction, toll houses, service\n\nstations, and administration, storage and other buildings which the\n\nAuthority may deem necessary for the operation of such turnpike,\n\ntogether with all property, rights, easements and interests which\n\nmay be acquired by the Authority for the construction or the\n\noperation of such turnpike. The Authority may contract or lease\n\nconcessions for gas stations, garages, restaurants, parking\n\nfacilities and other services for all or any portion of any turnpike\n\nproject or projects;\n\n3. “Cost”, as applied to a turnpike project, shall embrace the\n\ncost of construction, the cost of the acquisition of all land,\n\nrights-of-way, property, rights, easements and interests acquired by\n\nthe Authority for such construction, the cost of all machinery and\n\nequipment, financing charges, provision for working capital,\n\ninterest prior to, during, and after construction and a reserve for\n\ninterest in such amounts as the Authority shall determine, cost of\n\ntraffic estimates and of engineering and legal expenses, plans,\n\nspecifications, surveys, estimates of cost, and of revenues, other\n\nexpenses necessary or incident to determining the feasibility or\n\npracticability of constructing any such project, administrative\n\nexpense, and such other expense as may be necessary or incident to\n\nthe construction of the project, the financing of such construction,\n\nand the placing of the project in operation. Any obligation or\n\nexpense incurred by the Transportation Commission with the approval\n\nof the Authority for traffic surveys, borings, preparation of plans\n\nand specifications, and other engineering services in connection\n\nwith the financing and construction of a project shall be regarded\n\nas a part of the cost of such project and shall be reimbursed to the\n\nstate out of the proceeds of the turnpike revenue bonds hereafter\n\nauthorized. However, the Transportation Commission shall not incur\n\nobligations or expenses totaling more than One Thousand Five Hundred\n\nDollars ($1,500.00) per turnpike mile. Provided further, however,\n\nthat an additional sum not to exceed One Thousand Dollars\n\n($1,000.00) per turnpike mile may be expended for updating reports\n\nprior to financing; and\n\n4. “Owner” means and includes all individuals, copartnerships,\n\nassociations, or corporations having any title or interest in any\n\nproperty, rights, easements, and interests authorized to be acquired\n\nby this article.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b882ee3f5083272fb7e5e00021aa44a90ed58c850f0c7b02328142c1237af257","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1703","next":"us-ok/okla.-stat.-tit.-69-69-1705"},"notice":"GroundRules: Original legal text.
