Stat. tit. 69, § 69-1705","heading":"Authority - Powers and duties","body":"The Oklahoma Turnpike Authority is hereby authorized and\n\nempowered:\n\n(a) To adopt bylaws for the regulation of its affairs and\n\nconduct of its business.\n\n(b) To adopt an official seal and alter the same at pleasure.\n\n(c) To maintain an office at such place or places within the\n\nstate as it may designate.\n\n(d) To sue and be sued in contract, reverse condemnation,\n\nequity, mandamus and similar actions in its own name, plead and be\n\nimpleaded; provided, that any and all actions at law or in equity\n\nagainst the Authority shall be brought in the county in which the\n\nprincipal office of the Authority shall be located, or in the county\n\nof the residence of the plaintiff, or the county where the cause of\n\naction arose. All privileges granted to the Authority and duties\n\nenjoined upon the Authority by the provisions of Sections 1701\n\nthrough 1734 of this title may be enforced in a court of competent\n\njurisdiction in an action in mandamus.\n\n(e) To construct, maintain, repair and operate turnpike\n\nprojects and highways, with their access and connecting roads, at\n\nsuch locations and on such routes as it shall determine to be\n\nfeasible and economically sound; provided, that until specifically\n\nauthorized by the Legislature, the Authority shall be authorized to\n\nconstruct and operate toll turnpikes only at the following\n\nlocations:\n\n(1) The Turner Turnpike between Oklahoma City and Tulsa.\n\n(2) The Southwestern (H.E. Bailey) Turnpike between Oklahoma\n\nCity and Wichita Falls, Texas.\n\n(3) The Northeastern (Will Rogers) Turnpike between Tulsa and\n\nJoplin, Missouri.\n\n(4) The Eastern (Indian Nation) Turnpike between Tulsa and\n\nParis, Texas, including all or any part thereof between McAlester\n\nand the Red River south of Hugo.\n\n(5) The Cimarron Turnpike between Tulsa and Interstate Highway\n\n35 north of Perry, including a connection to Stillwater.\n\n(6) The Muskogee Turnpike between Broken Arrow and Interstate\n\nHighway 40 west of Webbers Falls.\n\n(7) All or any part of an extension of the Muskogee Turnpike,\n\nbeginning at a point on Interstate Highway 40 near the present south\n\nterminus of the Muskogee Turnpike, and extending in a southeasterly\n\ndirection on an alignment near Stigler, Poteau and Heavener to the\n\nvicinity of the Arkansas State Line to furnish access to Hot\n\nSprings, Texarkana, Shreveport and New Orleans.\n\n(8) A tollgate on the Turner Turnpike in the vicinity of\n\nLuther, Oklahoma, and in the vicinity of the intersection of State\n\nHighway 33 and Turner Turnpike in Creek County, Oklahoma, or in the\n\nvicinity of the intersection of State Highway 33 and Turner Turnpike\n\nor U.S. Highway 66 in Creek County, Oklahoma, from any monies\n\navailable to the Authority.\n\n(9) Add on the Will Rogers Turnpike a northbound automatic\n\ntollgate onto State Highway 28 and a southbound on-ramp from State\n\nHighway 28.\n\n(10) A turnpike or any part or parts thereof beginning in the\n\nvicinity of Duncan extending east to the vicinity of the City of\n\nDavis, and extending in a northeasterly direction, by way of the\n\nvicinity of the City of Ada, to a connection in the vicinity of\n\nHenryetta or in the vicinity of the intersection of State Highway 48\n\nand Interstate 40; and a turnpike or any part or parts thereof from\n\nthe vicinity of Snyder extending north to the vicinity of Woodward.\n\n(11) A turnpike or any part or parts thereof beginning at a\n\npoint in the vicinity of Ponca City, or at a point on the Kansas-\n\nOklahoma state boundary line east of the Arkansas River and west of\n\nthe point where Oklahoma State Highway No. 18 intersects said state\n\nboundary line, and extending in a southeasterly direction to a\n\nconnection with the Tulsa Urban Expressway System in the general\n\narea of the Port of Catoosa.\nart or parts thereof beginning at a\n\npoint in the vicinity of Ponca City, or at a point on the Kansas-\n\nOklahoma state boundary line east of the Arkansas River and west of\n\nthe point where Oklahoma State Highway No. 18 intersects said state\n\nboundary line, and extending in a southeasterly direction to a\n\nconnection with the Tulsa Urban Expressway System in the general\n\narea of the Port of Catoosa.\n\n(12) All or any part of an Oklahoma City toll expressway system\n\nconnecting the residential, industrial and State Capitol Complex in\n\nthe north part of Oklahoma City with the residential, industrial and\n\nWill Rogers World Airport Complex in the south and southwest parts\n\nof Oklahoma City.\n\n(13) A turnpike (The Industrial Parkway) or any part or parts\n\nthereof beginning at a point on the Oklahoma-Kansas state boundary\n\nline between the point where U.S. Highway 66 intersects the boundary\n\nline and the northeast corner of Oklahoma and ending by means of a\n\nconnection or connections with Shreveport, Louisiana, and Houston,\n\nTexas, in southeastern Oklahoma and at no point to exceed thirty\n\n(30) miles west of the Missouri or Arkansas border.\n\n(14) A turnpike or any part or parts thereof beginning in the\n\nvicinity of Velma or County Line to a point intersecting with\n\nInterstate 35 in the area south of Davis.\n\n(15) A turnpike or any part or parts thereof beginning in the\n\nvicinity of Watonga and extending south and/or east to the vicinity\n\nof north and/or west Oklahoma City.\n\n(16) A tollgate on the Will Rogers Turnpike near the\n\nintersection of State Highway 137 and the Will Rogers Turnpike,\n\nlocated south of Quapaw.\n\n(17) A tollgate on the Muskogee Turnpike in the vicinity of\n\nPorter, Oklahoma, a tollgate on the Will Rogers Turnpike in the\n\nvicinity of Adair, Oklahoma, a tollgate on the Turner Turnpike in\n\nthe vicinity of Luther, Oklahoma, and a tollgate on the H.E. Bailey\n\nTurnpike at Elgin, Oklahoma, from any monies available to the\n\nAuthority.\n\n(18) A tollgate on the Turner Turnpike in the vicinity of\n\nWellston, Oklahoma, from any monies available to the Authority.\n\n(19) A tollgate on the Muskogee Turnpike in the vicinity of\n\nBrushy Mountain, Oklahoma, and in the vicinity of Elm Grove,\n\nOklahoma, from any monies available to the Authority.\n\n(20) All or any part of an Oklahoma City Outer Loop expressway\n\nsystem beginning in the vicinity of I-35 and the Turner Turnpike and\n\nextending west into Canadian County and then south to I-40; and then\n\nsouth and east to I-35 in the vicinity of Moore and Norman; and then\n\nextending east and north to I-40 east of Tinker Field; and then\n\nextending north to the Turner Turnpike to complete the Outer Loop.\n\n(21) All or any part of the Tulsa south bypass expressway\n\nsystem beginning in the vicinity of the Turner Turnpike near Sapulpa\n\nand extending south and east to U.S. 75 in the vicinity of 96th\n\nStreet to 121st Street; and then east across the Arkansas River to a\n\nconnection with the Mingo Valley Expressway; and then south and/or\n\neast to a point on the Tulsa-Wagoner County Line near 131st Street\n\nsouth in the city of Broken Arrow.\n\n(22) A new turnpike or any part thereof from near the west gate\n\nof the Will Rogers Turnpike south to the west end of south Tulsa\n\nTurnpike at the Tulsa-Wagoner County Line.\n\n(23) A new turnpike or any parts thereof from the vicinity of\n\nthe connection between State Highway 33 and U.S. 69 easterly to the\n\nArkansas State Line.\n\n(24) A four-lane extension of the Muskogee Turnpike from\n\nInterstate Highway 40 west of Webbers Falls to the Poteau vicinity.\n\n(25) A new turnpike or any part or parts thereof beginning at a\n\npoint in the vicinity of northwest Tulsa, and extending in a\n\nnorthwesterly direction, by means of a connection or connections\n\nwith the cities of Pawhuska and Newkirk, to a point intersecting in\n\nthe vicinity of U.S. Highway No. 77 and the Kansas State Line.\nfrom\n\nInterstate Highway 40 west of Webbers Falls to the Poteau vicinity.\n\n(25) A new turnpike or any part or parts thereof beginning at a\n\npoint in the vicinity of northwest Tulsa, and extending in a\n\nnorthwesterly direction, by means of a connection or connections\n\nwith the cities of Pawhuska and Newkirk, to a point intersecting in\n\nthe vicinity of U.S. Highway No. 77 and the Kansas State Line.\n\n(26) A full access interchange on the Indian Nation Turnpike\n\nsouth of Interstate 40, in the vicinity of Henryetta, Oklahoma, and\n\nin the vicinity of the proposed theme park, museum or an industrial\n\nfacility which qualifies for the Oklahoma Quality Jobs Program Act,\n\nfrom any monies available to the Authority.\n\n(27) A new turnpike beginning at a point directly west of the\n\nArkansas line and four-laning Highway 70 from that point to the\n\nfarthest western reach of Highway 70 creating a southern route\n\nthrough Oklahoma.\n\n(28) A new turnpike and bridge or any parts thereof from a\n\npoint in the vicinity of the city of Mustang southerly across the\n\nSouth Canadian River to the H.E. Bailey Turnpike in the vicinity of\n\nthe city of Tuttle; and then easterly across the South Canadian\n\nRiver to a point in the vicinity of the city of Norman.\n\n(29) A new turnpike or any parts thereof beginning at a point\n\nin the vicinity of the city of Altus and extending in a\n\nnorthwesterly direction to a point in the vicinity of the city of\n\nSayre.\n\n(30) A new turnpike or any parts thereof beginning at a point\n\nin the vicinity of the city of Enid and extending in a westerly\n\ndirection to a point in the vicinity of the city of Woodward.\n\n(31) An on- and off-ramp or any parts thereof at Fletcher,\n\nOklahoma, in the vicinity of the Interstate 44 and State Highway 277\n\nintersection. Any existing on- or off-ramp or any parts thereof in\n\nthe vicinity of Fletcher, Oklahoma, shall not be removed and shall\n\nbe maintained pursuant to Section 1701 et seq. of this title.\n\n(32) A new bridge crossing the Arkansas River between South\n\nDelaware Avenue and Memorial Drive in Tulsa County. This project\n\nshall commence upon a determination by the Oklahoma Transportation\n\nAuthority that such bridge shall be self-sufficient at some point\n\nover a thirty-year time period from the toll charges associated with\n\nthe bridge project.\n\n(33) An exit ramp or any parts thereof from the eastbound lane\n\nof the Turner Turnpike at 96th Street in Tulsa.\n\n(34) An on- and off-ramp or any parts thereof on the Cimarron\n\nTurnpike in the vicinity of the northside of the Glencoe, Oklahoma,\n\nmunicipal limits.\n\n(35) A new turnpike or any parts thereof beginning at\n\nInterstate 44 at or near its intersection with 49th West Avenue,\n\npast State Highway 64/412, turning northeasterly, crossing 41st West\n\nAvenue, and continuing eastward to the L.L. Tisdale Expressway in\n\nTulsa, Oklahoma.\n\nAll access roads, interchanges, or lead roads connecting such\n\nturnpikes with existing highways must be built by funds furnished by\n\nthe Authority.\n\nThe minimum and maximum wages for the construction of the roads,\n\nhighways and projects provided for in Sections 1701 through 1734 of\n\nthis title shall be in accordance with the schedules of wages used\n\nor adopted by the Commission in construction of state highways.\n\nThe Authority is hereby authorized to enter into contracts or\n\nagreements with agencies and instrumentalities of other states or\n\nthe national government for construction, maintenance and operation\n\nof interstate turnpikes or highways.\n\nThe Authority is hereby required to construct and install\n\nautomatic tollgates on the Will Rogers Turnpike at State Highway No.\n\n28 near Adair.\nd Ferries Page 315\n\nThe Authority is hereby authorized to enter into contracts or\n\nagreements with agencies and instrumentalities of other states or\n\nthe national government for construction, maintenance and operation\n\nof interstate turnpikes or highways.\n\nThe Authority is hereby required to construct and install\n\nautomatic tollgates on the Will Rogers Turnpike at State Highway No.\n\n28 near Adair.\n\n(f) To issue turnpike revenue bonds of the Authority, payable\n\nsolely from revenues, including the revenues accruing to the trust\n\nfund created by Sections 1701 through 1734 of this title, for the\n\npurpose of paying all or any part of the cost of any one or more\n\nturnpike projects. Provided that any bonds issued for the\n\nconstruction of the proposed turnpike referred to in subparagraphs\n\n(10), (20), (21) and (22) of paragraph (e) of this section shall be\n\nissued as one issue for all four of the proposed turnpikes and shall\n\nbe financed, constructed and operated under one bond indenture.\n\n(g) To fix and revise from time to time tolls for the use of\n\nany turnpike projects.\n\nAny common carrier having authority at the time of opening any\n\nturnpike project to operate upon a highway approximately paralleling\n\nthe turnpike project shall be granted without further showing\n\nauthority to operate over the turnpike project to all municipalities\n\nwhich such carrier is serving at the time the turnpike project is\n\nopened to traffic. But nothing herein shall be construed as\n\ngranting any new operation rights to any common carriers.\n\n(h) To acquire, hold, and dispose of real and personal property\n\nin the exercise of its powers and the performance of its duties.\n\n(i) To acquire in the name of the Authority by purchase or\n\notherwise on such terms and conditions and in such manner as it may\n\ndeem proper, or by exercise of the right of condemnation in manner\n\nhereinafter provided, such public or private lands, including public\n\nparks, playgrounds, or reservations, or parts thereof or rights\n\ntherein, rights-of-way, property, rights, easements, and interests,\n\nas it may deem necessary for carrying out the provisions of Sections\n\n1701 through 1734 of this title; provided, that all public property\n\ndamaged in carrying out the powers granted by Sections 1701 through\n\n1734 of this title shall be restored or repaired and placed in its\n\noriginal condition as nearly as practicable.\n\n(j) To designate, except as is provided for herein, the\n\nlocation, and establish, limit and control such points of ingress to\n\nand egress from each turnpike project as may be necessary or\n\ndesirable in the judgment of the Authority to insure the proper\n\noperation and maintenance of such project, and to prohibit entrance\n\nto such project from any point or points not so designated.\n\n(k) To make and enter into all contracts and agreements\n\nnecessary or incidental to the performance of its duties and the\n\nexecution of its powers, and to employ consulting engineers,\n\nattorneys, accountants, construction and financial experts,\n\nsuperintendents, managers, and such other employees and agents as\n\nmay be necessary in its judgment, and to fix their compensation;\n\nprovided, that all such expenses shall be payable solely from the\n\nproceeds of turnpike revenue bonds issued under the provisions of\n\nSections 1701 through 1734 of this title or from revenues; provided,\n\nfurther, no attorney employed by the Authority, nor any member of\n\nany law firm of which the attorney may be connected, shall ever be\n\npaid any fee or compensation for any special or extraordinary\n\nservices.\nhat all such expenses shall be payable solely from the\n\nproceeds of turnpike revenue bonds issued under the provisions of\n\nSections 1701 through 1734 of this title or from revenues; provided,\n\nfurther, no attorney employed by the Authority, nor any member of\n\nany law firm of which the attorney may be connected, shall ever be\n\npaid any fee or compensation for any special or extraordinary\n\nservices.\n\n(l) To receive and accept from any federal agency grants for or\n\nin aid of the construction of any turnpike project, provided, the\n\nacceptance of such grants will not reduce the amount of federal aid\n\nfor the construction, repair, or maintenance of farm-to-market roads\n\nand other highways and bridges in this state; and to receive and\n\naccept aid or contributions from any source of either money,\n\nproperty, labor, or other things of value, to be held, used, and\n\napplied only for the purposes for which such grants and\n\ncontributions may be made.\n\n(m) To adopt such rules, and to do any and all things necessary\n\nto comply with rules, regulations, or requirements of the Bureau of\n\nPublic Roads, Multistate Economic Development Regional Commission,\n\nas defined in Sections 1151 through 1153, inclusive, of Title 74 of\n\nthe Oklahoma Statutes, Ozarka Region Commission or any other federal\n\nagency administering any law enacted by the Congress of the United\n\nStates to aid or encourage the construction of highways.\n\n(n) To do all things necessary or convenient to carry out the\n\npowers expressly granted in Sections 1701 through 1734 of this\n\ntitle. The design standards for all paving shall comply with the\n\ndesign standards of the American Association of State Highway and\n\nTransportation Officials as modified by the Oklahoma Department of\n\nTransportation. All contracts for construction work on turnpike\n\nprojects shall be let to the lowest responsible bidder, or bidders,\n\nafter notice by publication in a newspaper published in the county\n\nwhere the work is to be done in two consecutive weekly issues of the\n\nnewspaper. In all cases where more than eight (8) miles of\n\nconstruction is let at the same time and is not an advertisement for\n\na surface-treatment-only project, such advertisement shall provide\n\nfor bids on sections of the turnpike not to exceed eight (8) miles.\n\nIf the project advertised is a surface-treatment-only project of\n\nmore than twenty (20) miles of road, the advertisement shall provide\n\nfor bids on sections of the road no longer than twenty (20) miles,\n\nas well as bids on the project as a whole. Subject to the following\n\nrestrictions and limitations, the Authority shall, when contracting\n\nfor construction work, divide such work into paving projects, bridge\n\nprojects, including underpasses and overpasses, and earthmoving or\n\nmiscellaneous projects, according to the type of work to be done.\n\nEach project shall be let under a separate contract or contracts and\n\nno contract or project shall include more than one of such types of\n\nconstruction work. Each contract for construction work shall\n\ncontain a provision that ninety percent (90%) of all labor employed\n\non the project shall be residents of Oklahoma. However, contracts\n\nfor bridges may include earthwork and structures for the approaches\n\nthereto.\nhall be let under a separate contract or contracts and\n\nno contract or project shall include more than one of such types of\n\nconstruction work. Each contract for construction work shall\n\ncontain a provision that ninety percent (90%) of all labor employed\n\non the project shall be residents of Oklahoma. However, contracts\n\nfor bridges may include earthwork and structures for the approaches\n\nthereto.\n\n(o) It shall be unlawful for any member, officer or employee of\n\nthe Authority to transact with the Authority, either directly or\n\nindirectly, any business for profit of such member, officer, or\n\nemployee; and any person, firm, or corporation knowingly\n\nparticipating therein shall be equally liable for violation of this\n\nprovision.\n\nThe term \"business for profit\" shall include, but not be limited\n\nto, the acceptance or payment of any fee, commission, gift, or\n\nconsideration to such member, officer, or employee.\n\nViolation of this provision shall constitute a Class D1 felony\n\noffense punishable by incarceration as provided for in subsections B\n\nthrough F of Section 20N of Title 21 of the Oklahoma Statutes, or a\n\nfine of not less than Five Hundred Dollars ($500.00) and not more\n\nthan Five Thousand Dollars ($5,000.00), or both such imprisonment\n\nand fine.\n\n(p) In the event of a national emergency, the Authority,\n\nsubject to any vested rights or claims, may enter into contracts\n\nwith the federal government or any authorized agency thereof to\n\nallow the federal government or agency thereof to use such turnpikes\n\npartly or exclusively during the existence of such emergency,\n\nprovided, that the federal government agrees in such contract to\n\npay, during the term of such contract, an amount sufficient, when\n\nadded to any tolls collected, to meet all operating and maintenance\n\nexpenses, interest payments, and the minimum sinking fund and\n\nreserve requirements of the trust agreement for the turnpike covered\n\nby the contract.\n\n(q) All meetings of the Authority shall be open public\n\nmeetings, and all records shall be public records, except when\n\nconsidering personnel or litigation.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b695457d8fff0e6cbd2c498e850dbc6f2f2854c8fbbc96d0c4440282cc0cf2a3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1704","next":"us-ok/okla.-stat.-tit.-69-69-1705.1"},"notice":"GroundRules: Original legal text.
