Stat. tit. 69, § 69-1706","heading":"Grade separations - Vacation, relocation, and","body":"reconstruction of streets and highways - Entry on lands, waters and\n\npremises - Use of state lands.\n\nA. The Oklahoma Turnpike Authority may and it shall be its duty\n\nto construct grade separations at intersections of any turnpike\n\nproject with state and federal highways, and to change and adjust\n\nthe lines and grades of such highways so as to accommodate the same\n\nto the design of such grade separation. The Authority may construct\n\ngrade separations at intersections of turnpike projects with county\n\nhighways and city streets and it shall construct grade separations\n\nat intersections of any turnpike project with county highways used\n\nas mail or school bus routes, or section lines which are well used\n\nand are necessary for convenience of people living in these areas.\n\nThe cost of such grade separations and any damage incurred in\n\nchanging and adjusting the lines and grades of such highways shall\n\nbe ascertained and paid by the Authority as a part of the cost of\n\nsuch turnpike project. Except for routine surface maintenance, the\n\nAuthority shall maintain the structure and surface of bridges and\n\noverpasses where a county road crosses over or under a turnpike.\n\nB. If the Authority shall find it necessary to change the\n\nlocation of any portion of any state or county highway or street of\n\na municipality, it shall cause the same to be reconstructed in\n\nsubstantially the same type and in as good condition as the original\n\nhighway. Provided, however, that all changes and adjustments of the\n\nlines and grades of state highways shall be subject to the approval\n\nof the Transportation Commission. The cost of such reconstruction\n\nand any damage incurred in changing the location of any such highway\n\nor street shall be ascertained and paid by the Authority as a part\n\nof the cost of such turnpike project.\n\nC. In addition to the foregoing powers, the Authority and its\n\nauthorized agents and employees may enter upon any lands, waters,\n\nand premises in the state for the purpose of making surveys,\n\nsoundings, drillings, and examinations as it may deem necessary or\n\nconvenient for the purposes of establishing, locating, relocating,\n\nconstructing, and maintaining turnpikes or relocations thereof and\n\nfacilities necessary and incidental thereto. Such entry shall not\n\nbe deemed a trespass, nor shall an entry for such purpose be deemed\n\nan entry under any condemnation proceedings which may be then\n\npending; however, notice shall be given to the owner of or person\n\nresiding on the premises, personally or by registered mail, at least\n\nten (10) days prior to such entry. The Authority shall make\n\nreimbursement for any actual damages resulting to such lands,\n\nwaters, and premises as a result of such activities. In the event\n\nof disagreement as to the amount of damage, either the person or the\n\nAuthority may file a petition with the district court for the\n\nappointment of commissioners to appraise the damages and proceed to\n\nhave the same determined as in condemnation proceedings.\n\nD. The State of Oklahoma hereby consents to the use of all\n\nlands owned by it, including lands lying under water, which are\n\ndeemed by the Authority to be necessary for the construction or\n\noperation of any turnpike project; and the State of Oklahoma shall\n\nbe paid reasonable compensation for the land or property used, such\n\ncompensation to be determined in the manner now provided by law for\n\ncondemnation proceedings.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"377449c6568adf20641e5501e6f3ad7b3d818aad807a8d9d0847fb9e8bcf09a3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1705.6","next":"us-ok/okla.-stat.-tit.-69-69-1707"},"notice":"GroundRules: Original legal text.
