Stat. tit. 69, § 69-1707","heading":"Acquisition of lands and interests therein","body":"The Oklahoma Turnpike Authority is hereby authorized and\n\nempowered to acquire by purchase, or condemnation, land or such\n\ninterest therein as in its discretion may be necessary for the\n\npurpose of establishing, constructing, maintaining and operating\n\nturnpike projects or relocation thereof, and facilities necessary\n\nand incident thereto, or necessary in the restoration of public or\n\nprivate property damaged or destroyed, including borrow areas,\n\ndetours, channel changes, concession areas, public or private access\n\nroads, and deposits of rock, gravel, sand and other road building\n\nmaterial for use in turnpike construction and maintenance, upon such\n\nterms and at such price as may be considered by it to be reasonable\n\nand can be agreed upon between the Authority and the owner thereof,\n\nand to take title thereto in the name of the Authority, provided,\n\nthat such right and title shall be limited to the surface rights\n\nonly and shall not include oil or other mineral rights. Groundwater\n\nrights may be severed from surface rights, upon the written request\n\nof the owner of land to be acquired; however, an owner of\n\ngroundwater rights shall not have a right of access to the\n\nAuthority's acquired surface rights.
