The rights-of-way acquired by the Oklahoma Turnpike\n\nAuthority shall be held inviolate for turnpike and Authority\n\npurposes, and no physical or functional encroachments or uses shall\n\nbe permitted within such rights-of-way.\n\nB. It shall be unlawful for any person to construct, maintain\n\nor operate any gasoline pump, oil, gas or water drilling rig, line\n\nor structure, tank battery or other equipment or structure used in\n\nthe collection, processing or transportation of hydrocarbons or\n\nother minerals, driveway canopy, building, sign, fence, post, or any\n\nthing or structure on or overhanging any right-of-way, or upon or\n\noverhanging any turnpike, and the construction or maintaining of any\n\nsuch thing or structure on or overhanging any turnpike shall\n\nconstitute a public nuisance, which may be summarily abated by the\n\nAuthority or its trustees, officers, agents, servants and employees\n\nin the manner provided in subsection D of this section.\n\nC. This section shall not apply to the lawful use of such\n\nrights-of-way for the erection and operation of facilities of a\n\npublic utility as provided in Section 1722 of Title 69 of the\n\nOklahoma Statutes nor to the use of such rights-of-way with the\n\nexpress consent of the Authority.\n\nD. The Authority, its trustees, officers, agents, servants and\n\nemployees shall have authority to physically remove any such\n\ngasoline pump, oil, gas or water drilling rig, line or structure,\n\ntank battery or other equipment or structure used in the collection,\n\nprocessing or transportation of hydrocarbons or other minerals,\n\ndriveway canopy, building, sign, fence, post, thing or structure.\n\nIf the owner of any such gasoline pump, oil, gas or water drilling\n\nrig, line or structure, tank battery or other equipment or structure\n\nused in the collection, processing or transportation of hydrocarbons\n\nor other minerals, driveway canopy, building, sign, fence, post,\n\nthing or structure fails to remove the same within a reasonable time\n\nafter written demand for the removal thereof has been made upon such\n\nowner by registered mail or personal service, the Authority, its\n\ntrustees, its officers, agents, servants and employees may\n\nphysically tear down and remove such gasoline pump, oil, gas or\n\nwater drilling rig, line or structure, tank battery or other\n\nequipment or structure used in the collection, processing or\n\ntransportation of hydrocarbons or other minerals, driveway canopy,\n\nbuilding, sign, fence, post, thing or structure.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ac2440cada3d3146ce1eaf997e221f78259bbed6b1786b249561a8419e428135","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1722","next":"us-ok/okla.-stat.-tit.-69-69-1723"},"notice":"GroundRules: Original legal text.
