Stat. tit. 69, § 69-1913","heading":"Rural Economic Transportation Reliability and","body":"Optimization Fund.\n\nThere is hereby established a fund within the State Treasury to\n\nbe known as the \"Rural Economic Transportation Reliability and\n\nOptimization Fund\" to be administered by the Oklahoma Department of\n\nTransportation. The fund shall be a continuing fund, not subject to\n\nfiscal year limitations, and shall consist of any general revenues\n\nas may be directly appropriated or otherwise provided by law.\n\nAny monies appropriated to the Rural Economic Transportation\n\nReliability and Optimization Fund shall not result in a decrease in\n\nhistoric and traditional total state transportation funding levels\n\nor be used to supplant or replace existing state funds used for\n\ntransportation purposes.\n\nIn order to ensure that the funds from the Rural Economic\n\nTransportation Reliability and Optimization Fund are used to enhance\n\nand not supplant state funding for the Department of Transportation,\n\nthe State Board of Equalization shall examine and investigate the\n\nfunding levels as described. At the meeting of the State Board of\n\nEqualization held within five (5) days after the monthly\n\napportionment in February of each year, the State Board of\n\nEqualization shall issue a finding and report which shall state\n\nwhether expenditures from the Rural Economic Transportation\n\nReliability and Optimization Fund were used to enhance or supplant\n\nstate funding for the Department of Transportation. If the State\n\nBoard of Equalization finds that state funding for the Department of\n\nTransportation was supplanted by funds from the Rural Economic\n\nTransportation Reliability and Optimization Fund, the Board shall\n\nspecify the amount by which such funding was supplanted. In this\n\nevent, the Legislature shall not make any appropriations for the\n\nensuing fiscal year until an appropriation in that amount is made to\n\nreplenish state funding for the Department of Transportation.\n\nAll monies accruing to the credit of the Rural Economic\n\nTransportation Reliability and Optimization Fund are hereby\n\nappropriated and shall be used to assist the Department in the\n\nequitable prioritization of construction, repair and maintenance of\n\nstate highways in rural areas where robust economic development has\n\nresulted in traffic safety and circulation difficulties attributed\n\nto significant and unanticipated increases in traffic volumes and as\n\nfully recorded and documented by the Department. \"Robust economic\n\ndevelopment\", as used in this act, shall mean those conditions of\n\nthe highways of this state in counties with a population of less\n\nthan seventy-five thousand (75,000) where traffic volumes have\n\nincreased to become so impaired or hazardous as to constitute a\n\nthreat to the safety of persons or property traveling over or upon\n\nsuch highways.\n\nWhen such traffic conditions as described may arise in rural\n\nareas, the Department of Transportation shall engage the Oklahoma\n\nDepartment of Commerce, the Oklahoma Tax Commission or other\n\nagencies or entities of the state, as necessary, to confirm the\n\nrelationship of traffic conditions to robust economic development.\n\nOnce said relationship is confirmed and documented, the Department\n\nof Transportation may utilize any proceeds from the Rural Economic\n\nTransportation Reliability and Optimization Fund in an amount not to\n\nexceed fifty percent (50%) of the total project costs to incentivize\n\nand leverage the acceleration and prioritization of improvement\n\nprojects existing in or to be incorporated into the Department's\n\nEight-Year Construction Work Plan.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"16bd941af002f3f67336f5abff9261b5446fdc534d13b43e7db9e83f850bda2f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-1912","next":"us-ok/okla.-stat.-tit.-69-69-1930"},"notice":"GroundRules: Original legal text.
