Stat. tit. 69, § 69-304","heading":"State Highway System - Construction and maintenance -","body":"Powers of Commission.\n\n(a) The construction and maintenance of the State Highway\n\nSystem, and all work incidental thereto, shall be under the general\n\nsupervision and control of the Transportation Commission.\n\n(b) The Commission shall have power to make all final decisions\n\naffecting the work provided for herein, and all reasonable rules and\n\nregulations it may deem necessary, not inconsistent with this code,\n\nfor the proper management and conduct of such work, and for carrying\n\nout the provisions of this article, in such manner as shall be to\n\nthe best interest and advantage of the people of this state.\n\n(c) The Commission shall have power and authority to contract\n\nfor and purchase, lease or otherwise acquire any tools, machinery,\n\nsupplies, material or labor needed or to be needed for such work,\n\nhaving the deliveries of such articles made as actually needed, and\n\nto pay for engineering, preparation of plans and specifications,\n\ncosts of advertising, engineering supervision and inspection and all\n\nexpenses and contingencies in connection with the construction and\n\nmaintenance of the State Highway System. When quality and prices\n\nare equal, preference shall be given materials produced within the\n\nState of Oklahoma and highway construction companies domiciled,\n\nhaving and maintaining offices in and being citizen taxpayers of the\n\nState of Oklahoma.\n\n(d) The Commission shall have authority to make all contracts\n\nand do all things necessary to cooperate with the United States\n\nGovernment in matters relating to the cooperative construction,\n\nimprovement and maintenance of the State Highway System, or any road\n\nor street of any political or governmental subdivision or any\n\nmunicipal or public corporation of this state, for which federal\n\nfunds or aid are secured. Such contracts or acts shall be carried\n\nout in the manner required by the provisions of the Acts of Congress\n\nand rules and regulations made by an agency of the United States in\n\npursuance of such acts.\n\n(e) Any political or governmental subdivision or any public or\n\nmunicipal corporation of this state shall have the authority to\n\nenter into contracts through or with the Commission to enable them\n\nto participate in all the benefits to be secured from federal aid\n\nfunds, or funds made available from the federal government to be\n\nused on roads and streets. The Commission may negotiate and enter\n\ninto contracts with the federal government, or any of its\n\nconstituted agencies, and take all steps and proceedings necessary\n\nin order to secure such benefits for such political or governmental\n\nsubdivisions or public or municipal corporations.\n\n(f) The Commission, on behalf of the state, and any political\n\nor governmental subdivision or public or municipal corporation of\n\nthis state shall have the authority to enter into agreements with\n\neach other respecting the planning, designating, financing,\n\nestablishing, constructing, improving, maintaining, using, altering,\n\nrelocating, regulating or vacating of highways, roads, streets or\n\nconnecting links.\n\n(g) The Commission shall have authority to act in an advisory\n\ncapacity, upon request, to any political or governmental subdivision\n\nor public or municipal corporation of this state in matters\n\npertaining to the planning, locating, constructing and maintaining\n\nof roads, highways and streets and other related matters. The\n\nCommission, in such instances, may provide services and may\n\ncooperate with such subdivisions and corporations on such terms as\n\nmay be mutually agreed upon.\nest, to any political or governmental subdivision\n\nor public or municipal corporation of this state in matters\n\npertaining to the planning, locating, constructing and maintaining\n\nof roads, highways and streets and other related matters. The\n\nCommission, in such instances, may provide services and may\n\ncooperate with such subdivisions and corporations on such terms as\n\nmay be mutually agreed upon.\n\n(h) The Commission may purchase out of the State Highway\n\nConstruction and Maintenance Fund such commercial vehicles and\n\npassenger automobiles as may be necessary for the use of the\n\nDepartment and its employees in the construction and maintenance of\n\nthe State Highway System and all work incidental thereto, and in\n\ncarrying out the duties now or hereafter imposed upon the Department\n\nby the laws of this state.\n\n(i) The Commission may enter into written agreements with\n\nprivate citizens to allow such citizens to mow state highway rights-\n\nof-way and keep the clippings from such mowing as the sole\n\ncompensation therefor.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"13ac38b8e146a50173d03248515692859aa093d686ef3b88863e80f5ddb2e46f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-303-a","next":"us-ok/okla.-stat.-tit.-69-69-305"},"notice":"GroundRules: Original legal text.
