Stat. tit. 69, § 69-4002","heading":"Department of Transportation and the Transportation","body":"Commission - Creation.\n\nThere is hereby created in the Executive Branch of Government\n\nthe Department of Transportation and the Transportation Commission.\n\nThe Department shall function under the direct control and\n\nsupervision of the Commission as a part of the executive branch of\n\nstate government in carrying out the transportation policies, plans\n\nand programs of this state. In accord with appropriations made by\n\nthe Legislature and grants of funds from federal, state, regional,\n\nlocal or private agencies, the Department shall, acting by or\n\nthrough the Director or his duly authorized officer or employee,\n\nhave the power and it shall be its duty:\n\n1. To coordinate and develop for the State of Oklahoma a\n\ncomprehensive transportation plan to meet present and future needs\n\nfor adequate, safe and efficient transportation facilities at\n\nreasonable cost to the people.\n\n2. To coordinate the development and operation of such\n\ntransportation facilities in the state including, but not limited\n\nto, highways, public transportation, railroad, marine and waterways\n\nand aeronautics.\n\n3. To develop, periodically revise and maintain a comprehensive\n\nstate master plan for transportation facilities.\n\n4. To develop measurable objectives and goals designed to carry\n\nout the master plan for transportation and report progress in\n\nachievement of objectives and goals to the Governor and Legislature\n\nas part of the annual budget submission.\n\n5. To make such studies and analyses of transportation problems\n\nas may be requested by the Governor or Legislature relative to any\n\naspect of transportation in the state.\n\n6. To exercise and perform such functions, powers and duties as\n\nmay be from time to time conferred or imposed by law, including all\n\nthe functions, powers and duties assigned and transferred to the\n\nDepartment of Transportation by this act.\n\n7. To apply for, accept and receive and be the administrator\n\nfor and in behalf of the state agencies, boards and commissions of\n\nall federal or other monies now or hereafter available for purposes\n\nof transportation or which would further the intent and specific\n\npurposes of this act. This paragraph shall not apply to the\n\nOklahoma Corporation Commission insofar as federal funds for\n\ntransportation regulatory purposes are concerned. Provided further,\n\nnothing in this act shall be construed to limit the authority of any\n\ntown, city, county, regional authority, port authority or airport\n\nauthority to apply for, accept, receive and be the administrator of\n\nall federal funds or other monies now or hereafter available to such\n\nsubdivisions of government for the purpose of transportation or any\n\nother local matter. The provisions of this act shall not apply to\n\nfunds available for projects for providing transportation services\n\nto meet special needs of elderly and handicapped persons under\n\nSection 16 (b), (2) of the Urban Mass Transportation Act of 1964, as\n\namended (49 U.S.C.A., Section 1612 (b), (2)), or to programs\n\nadministered by the Department of Institutions, Social and\n\nRehabilitative Services for transportation services to elderly and\n\nhandicapped persons.\n\n8. To cooperate with local governments in the planning and\n\ndevelopment of transportation-related activities, and encourage\n\nstate and federally funded plans and programs at the local level\n\nconsistent with the goals and objectives of the state master plan\n\nfor transportation.\n\n9. To evaluate and encourage the development and use of public\n\ntransportation in Oklahoma where such use will contribute to a\n\nreduction in traffic congestion, public convenience, air quality, or\n\nenergy conservation. To administer financial assistance programs\n\nfor public transportation services, facilities and equipment, using\n\nstate and/or federal funds for administrative activities, and to\n\npass through to public, private enterprise and/or private nonprofit\nansportation in Oklahoma where such use will contribute to a\n\nreduction in traffic congestion, public convenience, air quality, or\n\nenergy conservation. To administer financial assistance programs\n\nfor public transportation services, facilities and equipment, using\n\nstate and/or federal funds for administrative activities, and to\n\npass through to public, private enterprise and/or private nonprofit\n\nentities those federal, local and/or private funds intended for the\n\npurpose of meeting public transportation capital and operating\n\nneeds, excluding those federal, local and/or private funds intended\n\nfor the purpose of meeting the capital and operating needs of fixed\n\nroute, regularly scheduled public transportation services operating\n\nwithin cities of greater than three hundred thousand (300,000)\n\npopulation according to the latest Federal Decennial Census. To\n\nensure, through positive actions, that private enterprise providers\n\nof public transportation are involved in all levels of public\n\ntransportation planning efforts, in both metropolitan and\n\nnonmetropolitan areas, and are given the opportunity to provide\n\npublic transportation services, by contract or other means which\n\nprovide a reasonable return, wherever such services are now or will\n\nbe provided utilizing federal, state or local public funds.\n\nExceptions to this requirement that private enterprise provide such\n\nservices may be made only where:\n\na. a county does not have an existing private enterprise\n\npublic transportation operator which could provide\n\nsuch services,\n\nb. the existing private enterprise public transportation\n\noperator declines to provide such service, or\n\nc. the organization seeking to secure or provide such\n\nservices by means other than private enterprise\n\noperators, such as operating the system themselves,\n\nprovides to the Department, or any other party upon\n\nrequest, budgetary documentation that the alternative\n\nmeans are more appropriate and less expensive on a\n\npassenger-mile basis.\n\nProvided, however, that there shall be exempted from the above\n\nrequirement all fixed route regularly scheduled public\n\ntransportation services, operating in cities of greater than three\n\nhundred thousand (300,000) population, according to the latest\n\nfederal decennial census; and\n\nProvided further, this act shall not alter any powers of\n\ncounties, cities and towns to initiate, designate, or construct any\n\nproject or other object of expenditure now or hereafter funded by\n\nfederal transportation or state gasoline and motor fuel tax funds\n\nallocated to those counties, cities and towns.","path":["OK Code","Title 69"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os69.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fdbb66a15ac36d6ef9eab791e70afe6d08c5272f5e88af8c9e1afa8cce2ad63a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-69-69-4001","next":"us-ok/okla.-stat.-tit.-69-69-4003"},"notice":"GroundRules: Original legal text.
