Stat. tit. 69, § 69-601.4","heading":"Application of waste oil to streets and roads","body":"prohibited.\n\nA. Except as otherwise provided in this section, the practice\n\nof applying waste oil to any street or road in this state is hereby\n\nprohibited. Upon authorization of the Corporation Commission and\n\ncompliance with the provisions of this section, a board of county\n\ncommissioners of any county in this state may apply waste oil to any\n\nstreet or road in the county.\n\nB. The Corporation Commission may issue authorization for the\n\napplication of waste oil on any street or road in this state. No\n\nauthorization shall be issued except upon proper application and a\n\nshowing by the county requesting such authorization that the use of\n\nwaste oil on the street or road is necessary for the care,\n\nmaintenance, and improvement of the street or road, that such\n\nactivity is in the public interest, and that the procedure for the\n\napplication of the waste oil shall be made in such a manner so as to\n\nprotect any adjoining public or private property from damage and\n\nmade in such a manner so as to prevent the pollution of surface and\n\nsubsurface waters.\n\nC. The Corporation Commission shall promulgate rules and\n\nregulations which are necessary to protect, from damage, public and\n\nprivate property adjoining any street or road upon which waste oil\n\nis to be applied and prevent the pollution of surface and subsurface\n\nwaters and which are reasonable and necessary to effectuate and\n\nenforce the provisions of this section including but not limited to\n\nthe types of waste oil which may be used in such applications and\n\nwhen the application of the waste oil shall be made. The\n\nCorporation Commission shall supervise the application of waste oil\n\nto ensure that such application is made in the manner required by\n\nthe rules and regulations promulgated by the Commission pursuant to\n\nthis section.\n\nD. Any person who authorizes the application of or applies\n\nwaste oil to any street or road without authorization of the\n\nCorporation Commission or in violation of any rule or regulation of\n\nthe Corporation Commission promulgated pursuant to this section\n\nshall be held personally liable. A proven violation of the\n\nprovisions of this section or of any rules or regulations\n\npromulgated thereto shall be punishable, in the first instance, by a\n\nfine not in excess of Two Thousand Five Hundred Dollars ($2,500.00).\n\nA second proven violation in any calendar year shall result in a\n\nfine not in excess of Five Thousand Dollars ($5,000.00). A third\n\nproven violation in any calendar year shall result in a fine not in\n\nexcess of Ten Thousand Dollars ($10,000.00) and suspension of\n\nauthority for up to thirty (30) days.\n\nE. For the purpose of this section, \"waste oil\" includes crude\n\npetroleum oil or other hydrocarbons produced from or obtained or\n\nused in connection with the drilling, development, producing and\n\nprocessing of oil or any residue obtained from any oil storage\n\nfacility.
